PRIVATE SEWAGE-LOCAL GOV REG

Amends the Private Sewage Disposal Licensing Act. Permits a unit of local government to require homeowners who maintain a private sewage disposal system within the unit of local government to provide verification, on an annual basis, to the unit of local government of a valid contract with a licensed private sewage disposal system installation contractor. Effective immediately.

VEH CD-SPEEDING-SURCHARGE

Amends the Illinois Vehicle Code. Provides that a municipality may enact an ordinance that requires a person who commits the offense of speeding to pay, in addition to any other penalty imposed by the court, a $10 surcharge. Provides that the surcharge is to be distributed to the municipality that issued the citation or made the arrest for the purpose of defraying the fuel costs of law enforcement agencies within the jurisdiction of the municipality. Effective immediately.

PUBLIC ACCESS COUNSELOR

Creates the Public Access Counselor and Formal Complaint Act. Establishes the Governor-appointed position of public access counselor to receive inquiries and publish interpretive and educational materials about the Freedom of Information Act and the Open Meetings Act. Requires the counselor to receive complaints and issue advisory opinions on denials of access to public records and public meetings. Provides for the operation of the counselor's office.

PUBLIC EMPLOYEE DISABILITY ACT

Amends the Public Employee Disability Act. Provides that if an employee subject to the Act is medically released as capable of performing light duties, that employee may be reassigned light duties and return to work.

USE/OCC TX-PROCEEDS-FUEL

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that, beginning August 1, 2009 and continuing through July 31, 2010, each month the Department shall pay into the Road Fund 35% of the net revenue realized for the preceding month from the 6.25% rate under the Acts on the selling price of motor fuel and gasohol. Effective immediately.

USE/OCC TX-PROCEEDS-FUEL

Amends the State Finance Act. Creates the LIHEAP Summer Cooling Program Fund as a special fund in the State treasury. Provides that moneys in the Fund may be used, subject to appropriation, only by the Department of Healthcare and Family Services for the purposes of the LIHEAP Summer Cooling Program. Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Requires the Department of Revenue to pay into the LIHEAP Summer Cooling Program Fund 100% of the net revenue realized for the preceding month from the 6.25% rate on the selling price of motor fuel and gasohol. Requires that these payments begin on the first month following the effective date of this amendatory Act and continue until the aggregate amount paid into that Fund under the Acts is $20,000,000. Effective immediately.

PEN CD-FIREFIGHTERS-INCREASES

Amends the Downstate Firefighter Article of the Illinois Pension Code. Provides that, in January 2010, the monthly pension of a firefighter who retired before July 1, 1971 shall be recalculated and increased to reflect the amount that the firefighter would have received in January 2010 had the firefighter been receiving an increase of 3% of the originally granted monthly pension for each year he or she received pension payments. Provides that in January of 2011, 2012, 2013, 2014, and 2015, he or she shall receive an additional increase of 5% of the originally granted monthly pension, and in each January thereafter, he or she shall receive an additional increase of 3% of the originally granted monthly pension. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
