INC TAX-CREDITS

Amends the Illinois Income Tax Act. Increases the amount of the earned income tax credit from 5% of the federal credit to: (i) 7.5% of the federal tax credit for taxable years ending in calendar year 2007; and (ii) 10% of the federal tax credit for taxable years ending in calendar year 2008 or thereafter. Effective immediately.

LANDLORD ADVANCE ENTRY NOTICE

Amends the Landlord and Tenant Act. Provides that before entering leased premises without the tenant's permission, a landlord shall provide the tenant with at least 24 hours notice except the landlord or the landlord's representative may enter without notice in an emergency.

UTILITIES-ACES ACT

Creates the Affordable and Clean Energy Standards (ACES) Act. Provides the findings of the General Assembly. Provides that electric utilities shall utilize cost-effective energy efficiency and load management investment in their energy resource portfolios according to specified guidelines. Provides that the Capital Development Board shall adopt the 2006 International Energy Conservation Code, without amendment, as the statewide residential building code for new home construction and significant additions or remodels of existing homes. Includes a severability clause. Preempts home rule. Effective immediately.

PROP TX-SPECIAL SERVICE AREAS

Amends the Special Service Area Law in the Property Tax Code. Authorizes municipalities to establish special service areas for repairing, reconstructing, or maintaining privately owned stormwater detention facilities. Sets forth procedures for establishing the special service areas. Exempts the special service areas from the Law's objection petition or disconnection procedures unless there exists a homeowners' association with legal duties concerning the detention facilities. Effective immediately.

PHTHALATES-CHILD PRODUCTS

Creates the Children's Products Safety Act. Provides that no person or entity shall manufacture, sell, or distribute in commerce any toy or child care article that contains di-(2-ethylhexyl) phthalate (DEHP), dibutyl phthalate (DBP), or benzyl butyl phthalate (BBP), in concentrations exceeding 0.1 percent. Provides that no person or entity shall manufacture, sell, or distribute in commerce any toy or child care article intended for use by a child under 3 years of age if that product can be placed in the child's mouth and contains diisononyl phthalate (DINP), diisodecyl phthalate (DIDP), or di-n-octyl phthalate (DnOP), in concentrations exceeding 0.1 percent. Provides that manufacturers shall use the least toxic alternative when replacing phthalates in accordance with the Act. Provides that manufacturers shall not replace phthalates with carcinogens rated by the United States Environmental Protection Agency as A, B, or C carcinogens, or substances listed as known or likely carcinogens, known to be human carcinogens, likely to be human carcinogens, or suggestive of being human carcinogens. Provides that manufacturers shall not replace phthalates with reproductive toxicants that cause birth defects, reproductive harm, or developmental harm as identified by the United States Environmental Protection Agency. Effective January 1, 2009.

MEDICAID-NURSING HOME RATES

Amends the Illinois Public Aid Code. In provisions concerning Medicaid rates for nursing homes, provides that for facilities licensed by the Department of Public Health under the Nursing Home Care Act as skilled nursing facilities or intermediate care facilities, the support component of the rates taking effect on July 1, 2008 shall be computed using the most recent cost reports on file with the Department of Healthcare and Family Services no later than April 1, 2006, updated for inflation to January 1, 2007. Provides that facilities shall have the support component of their Medicaid rate computed every year using the most recent cost reports on file with the Department of Healthcare and Family Services no later than April 1, 2 years prior to the year in which the new rate takes effect, updated for inflation to January 1 of the year prior to the year in which the new rate takes effect. Effective immediately.
