PROCUREMENT CODE-AGENCY DELAYS

Amends the Illinois Procurement Code. Provides for the identification and reporting of emergency purchases caused by agency process failures or delays; specifies the information to be reported. Effective immediately.

REINSTATES DEATH SENTENCE

Amends the Criminal Code of 2012 relating to first degree murder. Adds and eliminates aggravating factors for which the death penalty may be imposed. Amends the Code of Criminal Procedure of 1963. Eliminates provision that abolishes the sentence of death. Enacts the Capital Crimes Litigation Act of 2015. Provides that all unobligated and unexpended moneys remaining in the Death Penalty Abolition Fund on the effective date of the amendatory Act shall be transferred into the Capital Litigation Trust Fund. Amends the State Appellate Defender Act. Provides that in cases in which a death sentence is an authorized disposition, the State Appellate Defender shall provide trial counsel with legal assistance and the assistance of expert witnesses, investigators, and mitigation specialists from funds appropriated to the State Appellate Defender specifically for that purpose by the General Assembly. Provides that the Office of State Appellate Defender shall not be appointed to serve as trial counsel in capital cases.

ATHLETIC TRAINERS ACT

Amends the Regulatory Sunset Act. Removes a provision repealing the Illinois Athletic Trainers Practice Act on January 1, 2016. Amends the Illinois Athletic Trainers Practice Act. Provides that the maximum fine for violating the Act is $10,000 (rather than $5,000). Provides that the Department of Financial and Professional Regulation may summarily suspend the licenses of athletic trainers upon specified evidence; provides for expedited hearings for licenses summarily suspended. Provides that the Illinois Board of Athletic Trainers may (rather than shall) be consulted by the Secretary in disciplining licensees. Makes omnibus changes and corrections to the Act reflecting the practices of the Department of Financial and Professional Regulation in administering the Act. Changes references from "Director" to "Secretary". Defines terms. Provides that the Act is repealed on January 1, 2026. Effective immediately.

OCC TAX-ROAD FUND

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that, beginning July 1, 2016, each month the Department shall pay into the Road Fund 80% of the net revenue realized for the preceding month from the sale of motor fuel and gasohol. Provides that, beginning July 1, 2016, each month the Department shall pay 20% of the net revenue realized for the preceding month from the sale of motor fuel and gasohol into certain local tax funds. Effective immediately.

COVERING ALL KIDS-ELIGIBILITY

Amends the Covering ALL KIDS Health Insurance Act. Provides that a child is not eligible for coverage under the Covering ALL KIDS Health Insurance Program if he or she is an undocumented immigrant.

CMS-SURPLUS VEHICLES

Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Provides that all State-owned vehicles that were reported in the Performance Audit of the Department of Central Management Services' Operation of the State Vehicles Fleet released by the Office of the Auditor General in November 2011 to have been driven 7,000 miles or less in Fiscal Year 2010 are deemed surplus and shall be sold using a competitive sealed bid method of sale on or before January 1, 2017. Provides that proceeds from the sale of those vehicles shall be deposited in the same manner as proceeds from the sale of surplus vehicles for that vehicle's particular agency under current law. Sets forth certain exceptions. Effective immediately.

PARENTAGE-ACKNOWLEDGEMENT

Amends the Illinois Public Aid Code and the Illinois Parentage Act of 1984. Provides that an administrative determination of paternity that is not based on a voluntary acknowledgment of paternity made in accordance with the Illinois Public Aid Code may be challenged in court on the basis of fraud, duress, or material mistake of fact, with the burden of proof upon the challenging party and that, pending outcome of the challenge to the administrative determination of paternity, the legal responsibilities of the parties shall remain in full force and effect, except upon order of the court upon a showing of good cause. Provides that evidence that, based on DNA testing, the man who has been found to be the father of a child under an administrative determination of paternity is not the natural father of the child constitutes a material mistake of fact. Provides that such an action is barred if brought more than 6 months after the effective date of the amendatory Act or more than 2 years after the petitioner obtains actual knowledge of relevant facts, whichever is later, and that the 2-year period for bringing an action shall not extend beyond the date on which the child reaches the age of 18 years. Effective immediately.
