Amends the Illinois Income Tax Act. Provides that, for taxable years beginning on or after January 1, 2003, moneys contributed during the taxable year by the taxpayer for the purchase of an Illinois prepaid tuition contract, excluding moneys rolled over from another qualified tuition program account, may be deducted from the taxpayer's federal adjusted gross income in arriving at base income for Illinois income tax purposes. Exempts the deduction from the sunset provisions of the Act. Amends the Illinois Prepaid Tuition Act to include a reference to the deduction. Effective immediately.
Amends the Counties Code. Contains provisions concerning the fee the recorder shall receive for the recording of mortgages, trust deeds, deeds of trust, or other instruments securing an indebtedness in the nature of a mortgage and for releases of those instruments. Effective immediately.
Amends the Barber, Cosmetology, Esthetics, and Nail Technology Act of 1985. Makes a technical change in a Section concerning the inactive status of the license of a cosmetologist, cosmetology teacher, or cosmetology clinic teacher.
Creates the Illinois Stadium Clean Air Act. Provides that no person may smoke at any stadium in Illinois. Amends the Illinois Clean Air Act. Prohibits smoking in a hospital, an ambulatory surgical treatment center, a post-surgical recovery center, a dentist's or physician's office, any other health care professional office or facility (excluding the room of a resident in a Nursing Home Care Act-licensed facility), and a restaurant. Effective immediately.
Amends the Chicago Firefighter Article of the Illinois Pension Code. Increases the minimum retirement annuity to $1,200 per month on January 1, 2004 and to $1,400 on January 1, 2005 for persons who retire at age 50 or over with at least 20 years of service. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Amends the Technology Development Act. Creates a Technology Development Fund for use by the State Treasurer in paying the expenses of investments from the Technology Development Account. Permits the State Treasurer to use any excess for grants to schools to buy computers and to upgrade technology. Permits the State Treasurer to deposit up to 10% of the earnings on Account investments into the Fund. Effective immediately.
Creates the Window Guard and Guard Rail Act. Requires the installation of guards at every point of danger in residential buildings to prevent persons from falling. Requires that guards be installed in a manner approved by the Department of Public Health. Makes the knowing failure of a building owner or owner's agent to install guards a Class B misdemeanor. Provides that a building owner or owner's agent who knowingly fails to install guards is strictly liable in tort for injuries resulting from that failure. Requires the Department of Public Health to administer and enforce the Act. Restricts the concurrent exercise of home rule powers.
Amends the Freedom of Information Act. Provides that the exemption from inspection and copying requirements for architects' plans and engineers' technical submissions includes but is not limited to specified utility, transportation, public, and government facilities. Effective immediately.
Amends the Sex Offender and Child Murderer Community Notification Law. Provides that a manager of a condominium or of an apartment building shall post in a conspicuous place in the common areas of the condominium or apartment building a notice as to how a unit owner or renter can obtain information about persons who are registered as sex offenders under the Sex Offender Registration Act, including how to access information maintained in the Statewide Sex Offender Database that is posted on the Department of State Police Web site. Effective immediately.
