This resolution recognizes and expresses support for the efforts of democracy and human rights activists in Cuba.
Trans-Sahara Counterterrorism Partnership Program Act of 2021 This bill provides statutory authority for the Trans-Sahara Counterterrorism Partnership Program, an interagency program launched in 2005 to partner with countries in the Sahel and Maghreb regions of Africa to counter terrorism and violent extremism. The Department of State, in consultation with the Department of Defense and the U.S. Agency for International Development, shall establish the partnership program, which must coordinate all U.S. programs in North and West Africa related to various counterterrorism activities, such as building foreign-military capacity, enhancing border security, promoting youth employment, and supporting independent media to counter terrorist propaganda. The State Department must submit comprehensive, five-year strategies that include specified activities for the Sahel and Maghreb regions and for program counterterrorism efforts. Further, program activities must, among other things (1) be carried out in countries where there is an adequate level of partner country committment, and (2) have clearly defined outcomes and specific plans with indicators to regularly monitor and evaluate outcomes and impact. Such activities must also take into account the counterterrorism and development strategies of partner countries and align with such strategies to the extent possible. The State Department shall notify Congress before obligating funds for such programs, and must submit annual reports about program activities.
This resolution urges the President to facilitate private medical supply donations and to deliver urgently needed medical supplies, including oxygen generator plants, to India and countries neighboring India that are facing the spread of COVID-19.
Essential Caregivers Act of 2021 This bill requires skilled nursing facilities, nursing facilities, intermediate care facilities for the intellectually disabled, and nearby inpatient rehabilitation facilities to establish an essential caregivers program during a public health emergency. Under the program, facilities must allow each resident to select up to two essential caregivers to provide daily living assistance, emotional support, or companionship during the emergency. Facilities must afford such caregivers 12 hours of access to residents each day (or unlimited access for end-of-life care), and caregivers must agree to follow facility protocols for staff safety. Facilities may deny access to caregivers who violate protocols, subject to certain notification requirements; the Centers for Medicare & Medicaid Services must establish an appeals process relating to such decisions and may take specified enforcement actions against facilities that violate the bill's requirements.
Pandemic Unemployment Assistance Fraud Protection Act This bill creates several requirements for states to address fraudulent claims for Pandemic Unemployment Assistance (PUA), temporarily increases penalties for fraud related to PUA, and requires each state to establish a hotline for victims of unemployment fraud. Specifically, the bill requires states to cross reference PUA claims with federal and state prison records and E-Verify to ensure that claimants are eligible for PUA, submit to the Department of Labor plans to recover fraudulently obtained PUA, develop an anti-fraud task force to investigate and recover fraudulently obtained PUA, make restitution to Labor for the amount of any overpayment of PUA made by the state, and establish a hotline designed to encourage individuals who are victims of unemployment fraud and have received an incorrect statement of unemployment compensation to report that fraud. The bill also temporarily enhances the maximum penalty for fraud related to PUA through December 31, 2021, so that the offense is classified as fraud in relation to a presidentially declared major disaster or emergency and punishable by up to 30 years imprisonment, a fine of up to $1,000,000, or both.
Artistic Recognition for Talented Students Act or the ARTS Act This bill directs the Copyright Office to waive various copyright registration-related fees for works that win certain competitions sponsored by the Congressional Institute or established by Congress. To qualify for the fee waiver, the copyright registration application must be filed within a specified time frame, but the Copyright Office may waive fees for a qualifying work even if the application is filed outside the time frame.
Foreign Gain-of-Function Research Prevention Act of 2021 This bill prohibits the use of federal funds to conduct or support gain-of-function research involving potential pandemic pathogens by China, Russia, Iran, North Korea, or other foreign adversaries. Gain-of-function research is any research that is anticipated to confer an attribute on a pathogen to enhance its pathogenicity or transmissibility in mammals. If the Department of State finds that an entity has used funds for prohibited research, the entity may not receive any federal funding for a period of five years.
This bill recognizes the significance of the California Waterfowl Association on its 75th anniversary and the benefits of its work for California's waterfowl, wetlands, and public enjoyment of those waterfowl and wetlands.
Shark Fin Sales Elimination Act of 20 21 This bill addresses the sale of shark fins and the inclusion of rays and skates in the Seafood Traceability Program. The Seafood Traceability Program has data reporting and recordkeeping requirements at the time of entry for imported fish or fish products entered into U.S. commerce. The bill makes it illegal to possess, buy, or sell shark fins or any product containing shark fins, except for certain dogfish fins. A person may possess a shark fin that was lawfully taken consistent with a license or permit under certain circumstances. Penalties are imposed for violations under the Magnuson-Stevens Fishery Conservation and Management Act. The Department of Commerce must revise its regulations to include rays and skates as species that are subject to the Seafood Traceability Program.
Ocean Pollution Reduction Act II This bill revises requirements under the National Pollutant Discharge Elimination System (NPDES) permit program for the Point Loma Wastewater Treatment Plant in San Diego, California. Currently, the plant must meet standards established under the NPDES permit program for the primary and secondary treatment of wastewater discharged by the plant into marine waters. The city of San Diego may apply for permit modifications, which offer alternatives to certain secondary treatment standards. This bill eliminates the need for the city to obtain a separate permit for such modifications. Instead, the city may apply to obtain the permit modifications under the main NPDES permit if the plant meets certain conditions, such as the implementation of a pretreatment program.
