Clarifies that "traditional and customary subsistence farming", which is customary and traditional subsistence farming conducted by a native Hawaiian cultural practitioner for direct personal or family consumption. Provides that one of the State's policies under the Hawaii State Planning Act's socio-cultural advancement objectives is to assure the right of native Hawaiian cultural practitioners to engage in customary and traditional subsistence farming. Designates November 28 of each year as La Ku‘oko‘a Hawaiian Recognition Day, not constituting a state holiday, to celebrate the historical recognition of independence of the Kingdom of Hawaii. (SD1)
Requires each county to authorize construction for a specified number of new housing units between fiscal year 2021-2022 and 2024-2025. Reduces the amount of transient accommodation tax revenue the counties receive for failure to meet the requirements. Allows for recoupment of reduction under certain circumstances. Repeals June 30, 2025.
Requires each county to adopt ordinances authorizing detached dwelling units that meet certain minimum standards. Prohibits a county from denying a building permit under certain conditions. (SD1)
Prohibits businesses that sell age-restricted goods from requiring verbal disclosure of a customer's date of birth if it is clear that the individual has attained the age required to make a purchase. (SD1)
Requires licensed used motor vehicle part dealers to obtain a written statement by a seller of a catalytic converter that the seller has the lawful right to sell and dispose of the catalytic converter. Requires certain sellers of a catalytic converter to present a receipt or notarized declaration regarding the catalytic converter in certain circumstances. Prohibits a licensed used motor vehicle part dealer from purchasing a catalytic converter with no receipt or notarized declaration and to report the attempted sale to the police. Establishes the offense of theft of catalytic converter as a class C felony. (SD1)
Requires each county to prepare a housing supply plan to plan for projected increases in the State's housing supply to meet housing demands of the respective county, identify and analyze existing and projected housing needs for all income levels, define the term "housing demand" including a ratio of jobs to residents to account for latent demand, and identify adequate sites for housing, including rental housing. Requires housing supply plans to be submitted to the legislature. Appropriates funds for the counties to conduct the required studies.
Amends the Uniform Parentage Act to allow non-gestational partners to voluntarily establish parentage of a child during the period immediately prior to or following the birth of the child. Requires the State to recognize parentage determinations from other states and territories. (SD1)
Creates a statutory right of victims and witnesses of sexual offenses under part V of chapter 707, Hawaii Revised Statutes, to a speedy trial in criminal cases involving adult defendants. Requires the court and the prosecution to take appropriate action to ensure a prompt trial in order to minimize the length of time a child abuse victim or minor witness must endure the stress of the proceedings. Effective 5/1/2029. (SD1)
Requires developers of housing projects that are exempt from certain laws to enter into profit-sharing agreements with the tenants of those properties. Applies to new housing projects approved after July 1, 2021. (SD1)
