RELATING TO INDIVIDUAL DEVELOPMENT ACCOUNTS.

Expands eligibility for state-funded individual development accounts to households with income up to 100 percent of the area median income. Expands allowable uses of account funds to rental housing, transportation, costs related to the purchase or repair of a motor vehicle, and qualified business capitalization expenses for a small business. Clarifies certain requirements for fiduciary organizations. Reactivates the tax credit for the five-year period for taxable years 2020 through 2024. Effective 7/1/2050. (SD1)

RELATING TO ENERGY EFFICIENCY.

Requires energy consumption benchmarking for all nonresidential buildings. Requires disclosure of resulting benchmarking data to a prospective property buyer, lessee, or lender.

RELATING TO TRANSITIONAL AUTHORITY IN THE MORTGAGE INDUSTRY.

Implements section 106 of the Economic Growth, Regulatory Relief, and Consumer Protection Act, P.L. 115-174, by providing one hundred twenty-day temporary transitional authority to originate loans in this State for loan originators moving from a depository institution to a non-depository institution and state-licensed loan originators moving interstate. Effective 11/24/2019. (SD1)

RELATING TO CHECK CASHING.

Requires check cashers to be registered with the Department of Commerce and Consumer Affairs. Requires a check casher to offer a voluntary payment plan under certain circumstances. Provides the structure for voluntary payment plans. Clarifies that a customer may only have one outstanding deferred deposit transaction from any source. Amends notices required of check cashers. Removes the exemption from the regulations of check cashers for persons engaged in the bona fide retail sale of goods or services.

RELATING TO THE NURSING FACILITY SUSTAINABILITY PROGRAM.

Continues the nursing facility sustainability program for two additional years. Appropriates funds out of the nursing facility sustainability program special fund for fiscal years 2019-2020 and 2020-2021.

RELATING TO NONPROFIT CORPORATIONS.

Amends chapter 414D, Hawaii Revised Statutes, to: clarify that a public benefit corporation may not purchase its memberships; clarify that a person who does not have authority to vote as a member of the board is not a director; clarify that a corporation with members may designate its directors; increases the length of time that the Attorney General has to review proposed sale of substantially all of the assets of public benefit corporations other than in the regular course of its activities; permits electronic or digital signatures to constitute written consent if reasonable measures are used to authenticate the signatures; and makes housekeeping amendments. RELATING TO THE TRANSIENT ACCOMMODATIONS TAX.

Amends section 237D-6.5 to increase the distribution of state tax revenues to support natural resources programs, replaces the fixed appropriation amount with a percent distribution to each county.
