Repeals sections 4 and 5 of Act 206, Session Laws of Hawaii 2018, which created an electronic smoking device retailer registration unit within the Department of the Attorney General and created a fine for delivery sales of electronic smoking devices to persons under the age of twenty-one. Amends chapter 245, Hawaii Revised Statutes, by clearly classifying e-liquid and electronic smoking devices containing e-liquid as tobacco products subject to the tobacco tax.

Establishes a $100 fine for underage persons who smoke on public-school property or at public-school functions.
Authorizes the Department of Health to coordinate with each county wastewater agency to establish a low interest loan program to upgrade or convert cesspools to septic systems or aerobic treatment unit systems, or to connect cesspools to existing sewer systems or other wastewater treatment systems approved by the department. Requires check cashers to register with the department of commerce and consumer affairs. Requires check cashers to offer customers the option to participate in a payment plan, if certain conditions are met. Requires posting of certain information and written notice containing specific information to be provided to customers. Amends the limit, deposit deferral, and fees charged for deferred deposit transactions. Removes the exemption for entities engaged in the retail sale of good or services that periodically cash items for a fee. Effective 7/1/2020.
Permits the Director of Health to designate emergency departments to which persons requiring emergency mental health treatment may be taken by law enforcement.
Amends the excise tax rate on large cigars.
Establishes a schedule of penalties for employees and holders of retail tobacco permits or persons registered to sell electronic cigarette smoking devices who illegally sell tobacco products and electronic smoking devices to persons under 21. (SB1244 HD2)
Ensures that a variance for a demand water heater may only be granted if solar water heating is impracticable or cost-prohibitive, or if no renewable energy technology system can be substituted for use as the primary energy source for heating water. Requires that if a variance is granted for a property that will be connected to an electric utility grid, a grid-interactive water heater or a heat pump water heater be used in place of a solar water heater. Provides for penalties or fines for false attestation in variance applications.
Allocates additional transient accommodations tax revenues to the counties of Kauai, Hawaii, and Maui.
