PROPOSING AMENDMENTS TO ARTICLE VII, SECTIONS 12 AND 13, OF THE HAWAII CONSTITUTION TO EXPRESSLY PROVIDE THAT THE LEGISLATURE MAY AUTHORIZE THE COUNTIES TO ISSUE TAX INCREMENT BONDS AND TO EXCLUDE TAX INCREMENT BONDS FROM DETERMINATIONS OF THE FUNDED DEBT OF THE COUNTIES.

Proposes amendments to the Constitution of the State of Hawaiʻi to expressly provide that the legislature may authorize, by general law, political subdivisions, such as counties, to issue tax increment bonds and to exclude tax increment bonds in calculating the debt limit of the political subdivisions. RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.

Repeals the minimum age requirement for individuals who become an Employees' Retirement System member after 6/30/2012, and who have at least 25 years of credited service.

RELATING TO IMPORTANT AGRICULTURAL LANDS.

Clarifies the decision-making process for the Land Use Commission adoption of maps of Important Agricultural Lands and repeals the farm dwelling and farm employee housing incentive for lands designated as Important Agricultural Lands in chapter 205, Hawaiʻi Revised Statutes.

RELATING TO OCEAN RECREATION COMMERCIAL PERMITS.

Specifies the methods by which the Department of Land and Natural Resources can issue new ocean recreation commercial permits and renew existing ocean recreation commercial permits. Specifies that new permits for ocean recreation management areas and facilities where a permit limit is implemented, new permits will be issued by the method enumerated and in the order set forth herein until the limit is reached. For renewal of existing permits in ocean recreation management areas and facilities where a permit limit is implemented, the ability to renew a commercial permit will be based on seniority until the limit is reached.

RELATING TO WATER POLLUTION CONTROL.

Revises chapter 342D, Hawaiʻi Revised Statutes, to add definitions that are consistent with federal Clean Water Act regulations. Clarifies the Director of Health's role as a certifying agency including enforcement of water quality certifications, and increases certain statutory civil penalties. Effective 7/1/2050. (SD1)

RELATING TO VOTING.

Allows an individual who is seventeen years of age but will be eighteen years of age on or before the next general election to register and vote at the primary election immediately preceding that general election and in any co-occurring or intervening special election. Takes effect upon ratification of an appropriate constitutional amendment.

RELATING TO THE AFFORDABLE HOUSING REVOLVING FUND.

Amends the Supplemental Appropriations Act of 2022 to specify that the appropriation for Hawaiʻi housing finance and development corporation (BED160) is to be deposited into and expended from the affordable homeownership revolving fund for purposes of the revolving fund.
