Prohibits a public member of any board or commission under DCCA's purview from being engaged in the occupation that the board or commission regulates; being associated with a member of the occupation that the board or commission regulates that results in a material conflict of interest, an appearance of impropriety, or a reasonable suspicion that the public member does not represent the public interest; or having a financial interest in the regulated occupation. Establishes a parolee higher education pilot program that allows parolees to take classes up to twelve semester credits at no charge to the parolee; provided that the classes are taken within five years after release from a correctional institution and provided further that the parolee does not break or violate the terms of parole and other laws. Sunsets June 1, 2025.
Requires the Hawaii state energy office to develop a strategic plan that identifies strategies to achieve a resilient, clean energy, decarbonized economy as quickly as practicable and to submit the strategic plan to the legislature no later than twenty days prior to the convening of the Regular Session of 2023. Requires the Hawaii natural energy institute to conduct a feasibility study of the strategic plan and to submit its findings and recommendations to the legislature no later than twenty days prior to the convening of the regular sessions of 2023, 2028, 2033, 2043, and 2048. Includes e-liquid and electronic smoking devices within the definition of "tobacco products", as used in the cigarette tax and tobacco tax law. Establishes a tax of twenty per cent for the wholesale price for electronic smoking devices and 10 cents for each milliliter of e-liquid. Allocates a portion of funds collected on excise taxes on electronic smoking devices and eliquids to the trauma system special fund, community health centers special fund, and emergency medical services special fund.
Specifies that plans of correction and the status of corrective actions for care facilities shall be added to reports by the department of health within five working days. Clarifies, for reporting purposes, that the conclusion of an inspection occurs after the initial visit to a facility is completed.
Restricts asset forfeiture to cases involving the commission of a covered criminal misdemeanor or felony offense. Requires seized property to be forfeited only when the property owner has been convicted of an underlying covered criminal misdemeanor or felony offense. Changes the standard of proof that the State must meet in order for property to be forfeited from "preponderance of the evidence" to "beyond a reasonable doubt". Requires the State to prove that owners consented to or possessed knowledge of the crime that led to the seizure of their property. Requires that the agency seizing the property pay for safe and secure storage of the seized property until the completion of the forfeiture proceeding or final disposition of the property. Directs any proceeds from a civil forfeiture to the general revenue fund for public education purposes. Repeals administrative forfeiture proceedings.
Provides ranked choice method of voting for all partisan primary elections, special elections, and nonpartisan general elections held in this State on or after 1/1/2022 pursuant to certain conditions.
Requires landlords, lessors, or plaintiffs in a summary possession action based on nonpayment of monetary rent to submit a general excise tax license in good standing as a condition to the issuance of a writ of possession. Effective 5/6/2137. (HD1)
Requires the department of education's existing Free Application for Federal Student Aid (FAFSA) working group to create a state plan to make completion of the FAFSA or an opt-out waiver a statewide graduation requirement by the 2023-2024 school year.
