RELATING TO CONDOMINIUMS.

Specifies a procedure for condominium associations to incorporate power of sale language into their governing documents. Clarifies that liens may be foreclosed upon if the power of sale language is contained within an association's governing documents or within some other agreement with the owner of the unit subject to foreclosure. Effective 1/1/2050. (HD1)

RELATING TO CONSUMER PROTECTION.

Beginning 7/1/2023: provides for new viable installment-based small dollar loan transactions; specifies various consumer protection requirements for small dollar loans; requires licensure for small dollar lenders, subject to the oversight of the division of financial institutions of the department of commerce and consumer affairs; specifies licensing requirements for small dollar lenders; and caps the maximum allowable loan size at $1,500. Amends requirements for check cashers, including requiring check cashers to be licensed with the department of commerce and consumer affairs, to offer voluntary payment plans to consumers, and make various notice and disclosure requirements. Requires the division of financial institutions to conduct an analysis of the regulation of payday lenders and deferred deposit agreements and report to the legislature. Effective 7/1/2050. (HD1)

RELATING TO ELECTRONIC SMOKING DEVICES.

Makes unlawful the sale of flavored products for electronic smoking devices, mislabeling of e-liquid products containing nicotine, and sale of tobacco products other than through retail sales via in-person exchange. Establishes penalties. Includes e-liquid and electronic smoking devices in the definition of "tobacco products" for purposes of the cigarette tax and tobacco tax law. Increases the license fee for wholesalers and dealers of tobacco products and retail tobacco permit fee. Requires retailers to pay an additional excise tax on the retail price of electronic smoking devices on and after 7/1/2021. Directs a certain percentage of moneys received from the cigarette tax and tobacco tax to the Hawaii tobacco prevention and control trust fund to establish and fund a comprehensive youth tobacco cessation program. Requires a person under twenty-one years of age who unlawfully purchases or possesses tobacco products, including electronic smoking devices, to complete a tobacco education or use cessation program or perform community service for a first offense. Repeals the electronic smoking device retailer registration unit. Repeals provisions relating to delivery of sales under the cigarette tax and tobacco tax law.

RELATING TO THE VENDING FACILITIES PROGRAM.

Establishes a two-year vendor facilities pilot program task force for vendors with serious mental illness within the department of health. Requires the vendor facilities pilot program task force submit an annual report to the Governor and the Legislature not later than twenty days prior to the convening of the 2022 through 2023 regular sessions. Takes effect on 5/1/2029. (SD1)

RELATING TO ELECTRIC HYDROFOIL SURFBOARDS.

Requires the counties to issue permits for the operation of electric hydrofoil surfboards. Prohibits the operation of electric hydrofoil surfboards in the waters of west and south Maui between December 15 and May 15.

RELATING TO CANNABIS FOR MEDICAL USE.

Authorizes medical cannabis dispensaries to distribute cannabis propagules and cuttings to individuals authorized to cultivate cannabis plants for medical use, subject to quantity limits and quality requirements.

RELATING TO MEDICAL EQUIPMENT.

Requires the Hawaii Health Systems Corporation to create a plan to incorporated modern computed tomography equipment at Ka‘u Hospital by July 1, 2023. Requires a report to be delivered to the legislature no later than twenty days prior to the convening of the regular session of 2022.

RELATING TO POLICING.

Requires officers serving a warrant to declare the officer's office and business and wait thirty seconds before entry into a house, store, or other building, subject to certain circumstances. Requires officers serving a warrant issued by a district court to do so in an authorized uniform and wear and use a body-worn video camera. (CD1)

RELATING TO CONDOMINIUMS.

Repeals the provision relating to electronic voting devices. Clarifies that, notwithstanding any provision to the contrary in the declaration or bylaws, association meetings may be conducted by means of Internet, teleconference, or other electronic transmission technology that complies with Hawaii's Nonprofit Corporations Act. Provides that, except as otherwise specifically restricted by the declaration or bylaws, any action that may be taken at any annual, regular, or special meeting of members may be taken without a meeting by approval by ballot as provided in Hawaii's Nonprofit Corporations Act. In the event of an emergency or pandemic that adversely impacts the association's revenue, authorizes board to, without notice or approval of unit owners, use the association's replacement reserves or borrow money for operating expenses, and may grant the lender the right to assess and collect monthly or special assessments from the unit owners, and to enforce the payment of assessments or other sums by statutory lien and foreclosure proceedings.
