RELATING TO EMERGENCY POWERS.

Prohibits the Governor or a Mayor from suspending requests for public records or vital statistics during a declared state of emergency. Allows for a reasonable delay in an agency's response to a request as a result of extenuating circumstances.

RELATING TO BRAILLE LITERACY.

Establishes Braille literacy as a policy of the State. Requires literacy assessments for eligible low vision and blind students to include Braille instruction and the use of Braille. RELATING TO HISTORIC PRESERVATION.

Appropriate funds into and out of the Hawaii Historic Preservation Special Fund for the State Historic Preservation Division to inventory historic properties and burial sites in the State, collect data on burial site locations, and conduct an archaeological survey necessary to compile the inventory. RELATING TO THE RESIDENTIAL LANDLORD-TENANT CODE.

Allows tenants who prevail in a lawsuit for a violation of the Residential Landlord-Tenant Code to be awarded damages, reasonable attorney's fees, and costs of the suit.

RELATING TO TEMPORARY RESTRAINING ORDERS.

Increases the mandatory minimum jail sentence for a first conviction of knowingly or intentionally violating a temporary restraining order from forty-eight to seventy-two hours. Requires mandatory mental health counseling for a first conviction of knowingly or intentionally violating a temporary restraining order.

RELATING TO REAL PROPERTY TRANSACTIONS.

RELATING TO COGNITIVE ASSESSMENTS.

Requires all health care providers who accept Medicare to provide a cognitive assessment as part of the Medicare Part B annual wellness visit for Medicare beneficiaries sixty-five years of age or older, with certain exceptions. Requires health care providers to submit certain information to the Executive Office on Aging and the Executive Office on Aging to report de-identified aggregated data to the Legislature on an annual basis. Appropriates funds. Effective 1/1/2026.

RELATING TO GUBERNATORIAL APPOINTMENTS.

Requires any appointment of a person by the Governor to serve in the Executive Branch in the position of an advisor to be subject to the advice and consent of the Senate if that person's salary is greater than $200,000, and is not paid from the Governor's budget. Requires the Governor to transmit Governor's Messages to the Senate President containing nominations for each gubernatorial appointee who was appointed to their advisor position before the effective date of this Act and whose salary is greater than $200,000, and is not paid from the Governor's budget. Effective 1/1/2491. (SD1)
