RELATING TO HISTORIC PRESERVATION.

Defines "pre-contact historic property". Clarifies that the historic preservation program includes the development, publication, and distribution of materials about protections for burials, historic sites, and archaeological resources. Increases civil and administrative fines for certain violations of historic and preservation requirements and makes violators liable for costs associated with mitigation or restoration measures. RELATING TO ROADS.

Establishes a road connectivity task force to assess and identify ways of improving road access in rural areas and in subdivisions with substandard roads. Requires a report to the legislature.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.

Requires the employees' retirement system to reevaluate its investments in coal, oil, natural gas, oil or natural gas services, and pipeline companies and over the next five years, divest of holdings in any companies that have a majority of its holdings invested in fossil fuels, rather than clean renewable energy sources. Effective 7/1/2050. (HD1)

PROPOSING AN AMENDMENT TO ARTICLE I OF THE CONSTITUTION OF THE STATE OF HAWAII TO GUARANTEE ALL INDIVIDUALS THE RIGHT TO HAVE A CLEAN AND HEALTHY ENVIRONMENT.

Proposes a constitutional amendment that guarantees individuals the right to a clean and healthy environment, including pure water, clean air, healthy ecosystems, and a stable climate, and to the preservation of the natural, cultural, scenic and healthful qualities of the environment. Clarifies that the rights guaranteed may not be diminished by Article XI, Section 9, of the State Constitution. Effective 7/1/2050. (HD1)

RELATING TO AMERICAN SIGN LANGUAGE.

RELATING TO PUBLIC-PRIVATE PARTNERSHIPS.

Establishes the office of public-private partnership and the position of state public-private partnership coordinator. Adds design-build-finance-maintain, design-build-operate-maintain, and design-build-finance-operate-maintain project delivery methods to the state procurement code and related conditions and requirements. RELATING TO THE IMPORTANT AGRICULTURAL LAND QUALIFIED AGRICULTURAL COST TAX CREDIT.

Clarifies that a taxpayer can claim the credit in the third taxable year after they apply for the credit, rather than in any taxable year. Extends the time that the department of agriculture may certify the important agricultural land qualified agricultural costs tax credit from 12/31/2021 to 12/31/2030.

RELATING TO BOARD MEETINGS.

Allows boards to use interactive conference technology to remotely conduct public meetings under the sunshine law in conjunction with in-person meetings, even when no emergency has been declared by government authorities. Authorizes boards to exclude the public from nonpublic locations, such as homes, where board members are physically present when remote board meetings are held by interactive conference technology. Establishes requirements for the conduct of remote meetings. Establishes a new notice requirement to provide the board's contact information for the submission of written testimony by electronic or postal mail. Amends existing option to hold in-person meetings at multiple public meeting sites connected by interactive conference technology to require termination of meeting only if audio communication is lost and cannot be reestablished within an hour and the board had not provided reasonable notice of how the meeting would be continued. Allows for additional courtesy sites open to the public for remote and in-person meetings held by interactive conference technology. Allows for contact tracing and social distancing during states of emergency caused by contagious diseases. Effective 7/1/2050. (HD1)

RELATING TO HOUSING.

Authorizes the counties to reclassify lands fifty acres or seventy-five acres in certain rural, urban, and agricultural districts; provided that a certain percentage of the housing units on the land sought to be reclassified are set aside for persons and families with incomes at or below one hundred forty percent of the area median income. Establishes penalties for violations related to land use commission district boundary amendments. Effective 7/1/2050. (HD1)
