RELATING TO ACCESS TO TREATMENT FOR TERMINALLY ILL PATIENTS.

Beginning on January 1, 2024, permits manufacturers of investigational drugs or biological products to make these drugs and products available to terminally ill patients under certain conditions. Effective 12/31/2050. (SD1)

RELATING TO HOMESTEAD EXEMPTIONS.

Requires the Real Property and Financial Services Section of the Hawaii State Bar Association to conduct a study to determine an appropriate increase to the homestead exemption in bankruptcy proceedings. Effective 7/1/2112. (SD1)

RELATING TO HEALTH.

Appropriates funds to the Department of Health to develop and implement statewide media, education, and training activities for policies related to emergency examination and hospitalization and assisted community treatment for those in need of mental health intervention. (SD1)

RELATING TO COURTS OF APPEAL.

Prohibits the State's Supreme Court and Intermediate Appellate Court from affirming, modifying, reversing, or vacating a matter on grounds other than those raised by the parties to the proceeding, unless the parties are provided the opportunity to brief the court. Requires a rehearing upon timely petition of any party, if the courts fail to afford the opportunity for parties to submit supplemental briefing.

RELATING TO THE JUDICIARY.

Clarifies that the disqualification requirements for judges also apply to justices. Establishes a process by which a party before an appellate court in the State, who believes that the judge or justice presiding over their case may have a disqualifying conflict of interest, may move for a hearing on possible conflict of interest. Prohibits the appellate court judge or justice who is subject to the motion to hear or rule on the motion but allows them to file a response or voluntarily recuse themselves from presiding over the pending action or proceeding.

RELATING TO ELECTIONS.

Requires notice and identification of certain top donors who contributed to a noncandidate committee. Changes the requirement of certain information from the schedules filed with the noncandidate committee reports. Removes certain information required for the late contribution report. Increases the amount of disbursement for electioneering communication that is required to be disclosed. Requires noncandidate committees that make only independent expenditures and spend over $10,000 to maintain transfer records and provide certain notice to donors. Repeals the top contribution identification requirement.

RELATING TO MARINE LIFE CONSERVATION DISTRICTS.

Requires the Department of Land and Natural Resources to establish and conduct the Marine Life Conservation District Carrying Capacity Program. Requires the Department of Land and Natural Resources to submit reports to the Legislature. Appropriates funds. Effective 7/1/2050. (SD1)

RELATING TO GOVERNMENT RECORDS.

Adds an exception to mandatory disclosure of government records for deliberative and pre-decisional government inter-agency or intra-agency records concerning an agency decision about a government action. From July 1, 2023, through June 30, 2027, requires agencies to report their use of the exception to the Office of Information Practices. Effective 7/1/2112. (SD1)
