Provides that where public access is required as a condition of a subdivision, the county shall either accept dedication of and maintain the access or identify an entity to own and maintain the access. Authorizes the county to require the subdivider to establish a stewardship fund for maintenance purposes.
Establishes the hike safe card program and search and rescue special fund to be administered by the Department of Land and Natural Resources. Requires government entities to seek reimbursement for all or a portion of search or rescue expenses when the person or entity knowingly enters state, county, or private property, knowingly enters a hiking trail that is closed to the public, or violates applicable laws, provided that the closure is posted by sign, barricade, or other device that gives reasonable notice of the closure. Exempts persons who possess a hike safe card from search and rescue cost reimbursement, under certain conditions. Requires counties and the State Fire Council to adopt ordinances or rules as necessary to pursue reimbursements. Raises the penalty for criminal trespass from a petty misdemeanor to a misdemeanor. Declares that the general fund expenditure is exceeded. Makes an appropriation.
Authorizes the Department of Education to establish a recognition program to incentivize schools to submit to the Department a plan for the school to reach the local farm to school meal goal of thirty per cent of food served in the school to consist of locally sourced products by 2030. Requires public high schools under the Department of Education to provide plantbased meals as an option under the school meals program.
Requires a wastewater treatment plant to test sewage sludge and any other residual material for the presence of perfluoroalkyl and polyfluoroalkyl substances. Requires the Department of Health to adopt administrative rules for the safe disposal and sequestration of sewage sludge and other residual material that contain any amount of perfluoroalkyl and polyfluoroalkyl substances. Prohibits the issuance or renewal of permits if testing yields perfluoroalkyl and polyfluoroalkyl substances in sewage sludge or other residual material on land used for agronomic purposes, on land where drainage tiles have been installed, on land that drains into waters of the State, or land in a five hundred-year floodplain.
Appropriates funds to the governor for the ohana zones pilot program.
Authorizes a court to order the forfeiture of all of the Employees' Retirement System (ERS) benefits of an ERS member, former member, or retirant upon conviction of the individual for a felony related to the state or county employment of the individual.
Requires the Department of Health to construct, establish, and operate an environmental toxins testing laboratory to test samples submitted by the public for diseases; water, air, and soil quality; and complex testing. Allows the Director of Finance to issue general obligation bonds.
Increases the bonus for teachers who achieve and maintain a current national board certification from $5,000 to $15,000. Appropriates funds.
Taxes capital gains income at the same rate as ordinary income.
Repeals existing law that preempted local ordinances or regulations that regulate the sale of cigarettes, tobacco products, and electronic smoking devices and nullified and voided any conflicting local laws and regulations. Allows counties to adopt ordinances that regulate the sale of cigarettes, tobacco products, and electronic smoking devices that do not conflict with and are more stringent than the state law that governs smoking.
