Requires by the end of the 2020-2021 school year that all public schools; public charter schools; and University of Hawaii and its divisions, campuses, and institutions have automated external defibrillators on campus. Requires the public schools; public charter schools; and University of Hawaii divisions, campuses, and institutions that have an athletic trainer to ensure that the athletic trainer is trained and certified in the use of an automated external defibrillator. Authorizes the issuance of general obligation bonds and appropriate funds for the construction of an invertebrate and plant propagation facility and baseyard improvements on Oahu, a predator proof fence on Oahu, and a predator proof fence on Maui.
Repeals several exemptions from the prohibition on operating a pickup truck with a passenger seated in the bed or load-carrying area, including the exemption that allows passengers over twelve years of age to ride in the bed or load-carrying area. Reduces the fine for violating the prohibition.
Appropriates funds for a state civil service position to draft rules that implement and clarify the intent of chapter 195D, Hawaii Revised Statutes, work with applicants for incidental take licenses to develop their projects to minimize and mitigate incidental take of threatened and endangered species to the maximum extent practicable, and effectively track and monitor funds and expenditures related to habitat conservation plans and perform other tasks to benefit the recovery of threatened and endangered species. Allows a defendant who has been convicted of three misdemeanors in Waikiki to be sentenced to a probationary term of geographic restriction not exceeding years during which the defendant shall be prohibited from entering Waikiki during the hours of 6:00 p.m. to 6:00 a.m. Imposes imprisonment of thirty days for violation.
Requires the State Commission on the Status of Women to maintain a database on sex trafficking. Requires reports to the Legislature. (SD1)
Restricts asset forfeiture to cases involving the commission of a covered criminal misdemeanor or felony offense. Requires seized property to be forfeited only when the property owner has been convicted of an underlying covered criminal misdemeanor or felony offense. Changes the standard of proof that the State must meet in order for property to be forfeited from "preponderance of the evidence" to "beyond a reasonable doubt". Requires the State to prove that owners consented to or possessed knowledge of the crime that led to the seizure of their property. Requires that the agency seizing the property pay for safe and secure storage of the seized property until the completion of the forfeiture proceeding or final disposition of the property. Directs any proceeds from a civil forfeiture to the general revenue fund for public education purposes. Repeals administrative forfeiture proceedings. (SD1)
Appropriates funds for the GoFarm Hawaii program. Requires GoFarm Hawaii to provide the chairperson of the board of agriculture with the program's annual goals and a semi-annual report outlining program outputs and outcomes.
Transfers jurisdiction and management of the parking lot surrounding Iolani Palace from the department of accounting and general services to the department of land and natural resources. (SD1)
Specifies that the filing date for candidate committee preliminary reports is thirty days, rather than ten days, before a general, subsequent special, or subsequent nonpartisan election. Specifies that the filing date for candidate committee preliminary reports is sixty and then thirty days, rather than thirty days and then ten days, before a primary, initial special, or initial nonpartisan election and that the report filed sixty days before the election shall be current through May 31. Amends the filing due dates for noncandidate committee reports to correspond with the due dates for candidate committee reports.
