Sen. Mike Gabbard

Amends the definition of "hemp product" to exclude delta-8-tetrahydrocannabinol. Prohibits the sale of food products and hemp products that contain delta-8-tetrahydrocannabinol. Allows the sale of food products infused with cannabinoid, hemp extract, hemp derivatives, or other hemp products. Allows the sale of hemp leaves and hemp floral material. Requires the identity statement used for labeling or advertising of hemp products to clearly identify the hemp's place of origin. Effective 6/29/2023.

Appropriates funds for the Department of Health to retain experts to identify necessary public outreach and education resources and tools and develop a comprehensive public outreach strategy and website to provide necessary information to educate homeowners to meet the State's statutory January 1, 2050, cesspool conversion deadline.

Amends the definition of "imminent harm" for the purposes of the Child Protective Act. Requires a police officer assuming protective custody without a court order of a child to provide to the Department of Human Services a written report detailing the officer's observations justifying the immediate removal of the child. Requires a copy of the police report to be provided to the parents of the child and to the court. Requires the Department of Human Services to provide written notice to a child's parent of the parent's rights when conducting certain investigations.

Requires the Department of Health, with assistance from each county, to develop a statewide needs assessment to determine resources necessary to reduce packaging waste by seventy per cent from the baseline amount. Requires the Department of Health to establish an advisory council by 1/1/2024 to advise the Department on how to structure a producer-funded packaging waste reduction and reuse program. Requires the Department of Health to: (1) develop a packaging waste reduction and reuse program by December 31, 2025, and (2) publish and implement a packaging waste reduction and reuse plan, beginning July 1, 2026. Establishes the Packaging Waste Special Fund. Makes appropriations.

Requires the Department of Education to establish long-term targets to locally source sixty per cent of school meals and zero-emission vehicle goals as part of the Sustainable Schools Initiative. Requires an annual report to the Legislature.

Requires recycling of construction and demolition materials and use of recycled materials to factor into priority offeror selections for competitive procurements of construction or demolition services by the State or any county. Requires the State Building Codes to incorporate the International Green Construction Code and set specified targets for the recycling, reuse, donation, and resale of nonhazardous construction waste.

Establishes a visitor green fee program that requires that visitors purchase a license which is valid for one year for the use of a state park, beach, state-owned forest, hiking trail on state-owned land, or other state-owned natural area, to be administered by the department of land and natural resources. Establishes a visitor green fee special fund, into which shall be deposited fees, penalties, appropriations, and gifts and donations for the program. Establishes an environmental legacy commission, which shall be responsible for allocating disbursements and awarding grants from the visitor green fee special fund for the protection, restoration, enhancement, care, and increased resilience of Hawaii's natural and outdoor recreational resources. Appropriates fund for the establishment of the environmental legacy commission and a strategic plan. Requires annual reports to the legislature on the progress of the program.

Establishes the mold information and awareness program administered by DOH. Requires mandatory disclosure of the presence of mold as part of any sale, transfer, or rental of residential, commercial, or industrial property. Requires DOH to conduct reviews every five years on mold identification and remediation technology or treatment techniques. Requires the director of health to establish a public awareness campaign. Requires disclosure forms for the sale of residential real property to include a notice to buyers about the presence of mold, if applicable. Requires a landlord or any person authorized to enter into a rental agreement on the landlord's behalf to disclose the presence of mold, if applicable. Requires DOH to study the adverse effects of mold on humans and report to the legislature.

Establishes the Aquaculture Development Branch within the Department of Business, Economic Development, and Tourism. Transfers the rights, powers, functions, duties, employees, and other capital of the Aquaculture and Livestock Services Branch of the Department of Agriculture to the new Aquaculture Development Branch. Makes appropriations.
