RELATING TO THE FOOD SERVICES BRANCH.

Requires the department of education food services branch to coordinate with the principals and vice principals of department schools to determine which school meal program offered by the USDA is the best fit for the student body and campus of each school.

RELATING TO COMMERCIAL SHARK TOURS.

Prohibits commercial shark tour operations from operating without a permit. Requires the department of land and natural resources to adopt rules to regulate commercial shark tours. Effective 1/1/2022. (SD1)

RELATING TO TECHNOLOGY.

Creates the Hawaii Diversification and Resilience in a Vibrant Economy Program (HI DRiVE) and special fund, which requires the Hawaii technology development corporation to build on small business innovation research phase II awards and use funds to support phase III efforts to commercialize technology, develop manufacturing infrastructure, acquire equipment or materials, and support training or quality systems. Requires the governor to apply for $100,000,000 in economic diversification assistance from the federal government for the creation of the HI DRiVE program.

RELATING TO WASTE MANAGEMENT.

Broadens the definition of "food waste" as used in integrated solid waste management. Excludes facilities designed primarily for composting organic material such as food waste and green waste, on-site school campus food waste programs, and recycling drop-off facilities from the requirement that disposal facilities shall not be constructed, modified, or expanded without first establishing a buffer zone of no less than one-half mile from the nearest residential, school, or hospital property line. Establishes a class of artisan-scale composting operations exempt from department of health regulations to divert organic materials from Hawaii's landfills. Takes effect 7/1/2050. (SD1)

RELATING TO HAWAIIAN LANGUAGE.

Requires all letterheads, documents, symbols, and emblems of the State and other political subdivisions that include Hawaiian words or names to include accurate and appropriate Hawaiian names, spelling, and punctuation. Establishes references for accurate, appropriate, and authentic Hawaiian names and words, including proper Hawaiian spelling and punctuation. Clarifies that the full text of bills and other official documents are not required to be written in Hawaiian and that misspelled or incorrectly punctuated Hawaiian words and names shall not invalidate the documents or render them unenforceable and no cause of action shall arise accordingly.

RELATING TO THE MODERNIZATION OF CRIMINAL JUSTICE.

Defines serious crime as murder or attempted murder in the first degree or class A felony, or a call B or C felony involving violence of threat of violence. Allows the court to determine if bail may be denied where the charge is for a serious crime. Requires the judicial council to appoint a committee to review and recommend changes to the Hawaii penal code. Takes effect 7/1/25. (SD1)

RELATING TO THE TRANSFER OF NON-AGRICULTURAL PARK LANDS.

Requires the department of land natural resources and department of agriculture to meet and identify the non-agricultural park lands that should be rezoned as those in the conservation district. Requires that agricultural lands under the jurisdiction of the department of land and natural resources be transferred to the department of agriculture not later than 12/31/2023. Requires the department of land and natural resources and department of agriculture to meet every five years to discuss transferring remaining lands. Requires the department of agriculture to inquire about any easements needed by the department of land and natural resources before offering a lease. (SD1)

RELATING TO MEDICAL CANNABIS.

Creates a cultivation facility license, which allows cultivators to grow cannabis for sale to licensed dispensaries. Establishes requirements for license application and qualifications for license holders. Establishes requirements for cultivation facility operations, including plant tracking and testing. Clarifies that cultivation facilities may sell product only to licensed dispensaries. Authorizes the Department of Health to determine the number of cultivation licenses to be issued. Allows one cultivation license to be issued per tax map key number. Limits the number of cannabis plants grown at each cultivation facility to one thousand. Effective 7/1/2050. (SD1)

RELATING TO CRIME.

Establishes a special intergovernmental task force to eradicate illegal gambling and drug activities and to establish community safe zones across the State. Requires a report to the legislature. (SD1)

RELATING TO AGRICULTURE.

Clarifies that "traditional and customary subsistence farming", which is customary and traditional subsistence farming conducted by a native Hawaiian cultural practitioner for direct personal or family consumption. Provides that one of the State's policies under the Hawaii State Planning Act's socio-cultural advancement objectives is to assure the right of native Hawaiian cultural practitioners to engage in customary and traditional subsistence farming. Effective 7/1/2060. (SD1)
