Provides that the court may appoint one qualified examiner instead of three, to evaluate a criminal defendant's fitness to proceed or regaining fitness to proceed in all penal cases and removes the requirement that examiner shall be from within the Department of Health. On July 1, 2022, the requirement shall be three qualified examiners for felony cases and one examiner in non-felony cases. One of the examiners shall be from within the Department of Health. Eliminates the mortgage interest deduction for second homes under the Hawaii Income Tax Law. Specifies that the revenue gain attributable to this measure be deposited into the Rental Housing Revolving Fund. Requires the Department of Budget and Finance, in consultation with the Department of Taxation, to submit reports on the administration of this measure to the Legislature prior to the 2018, 2019, 2020, 2021, and 2022 Regular Sessions. Requires the Department of Transportation to establish a weigh in motion and axle scale system at all commercial harbor facilities. Requires maritime cargo carriers to report to the Department containers or loads subject to highway weight restrictions. Appropriates funds. (HB725 HD2)
Extends the prohibition that prevents the counties from requiring fire sprinklers in specific family dwelling units and nonresidential agricultural and aquacultural buildings. (HB1384 HD3)
Limits the ability of the board of directors of a planned community association to impose excessive regular assessments or special assessments, except in emergency situations, without the approval of a majority of members present at an association meeting or by the written consent of the majority of members without a meeting. Establishes a working group to address and provide findings and recommendations regarding issues that beneficiaries of the department of Hawaiian home lands on Hawaii island face relating to the financing and insuring of homes. Appropriates funds.
