Extends the nursing facility sustainability program to 2021. Allows the nursing facility sustainability fee to be used to enhance capitated rates for the purpose of paying quality incentives. Increases the nursing facility sustainability fee limit from 4.0% to 5.5% of net patient service revenue. Increases the per resident daily maximum fee from $13.46 to $20 for each facility, and increases the per resident reduced daily maximum fee from $5.85 to $9 for facilities that meet certain exceptions. Extends the hospital sustainability program for two years. Clarifies exemptions from the hospital sustainability fee and increases the allowable aggregate fees to be charged. Appropriates funds out of the hospital sustainability special fund for fiscal years 2019-2020 and 2020-2021. (HB1270 CD1)
Amends the affirmative defense of extreme mental or emotional disturbance to murder or attempted murder by prohibiting explanations based solely on the defendant's discovery, defendant's knowledge, or the disclosure of the victim's gender, gender identity or expression, or sexual orientation. Requires the court to instruct the jury to disregard bias and prejudice if a defendant's explanation includes the discovery of a victim's gender, gender identity or expression, or sexual orientation. Clarifies that the ban on sexual orientation change efforts applies to conversion therapy practices or treatments that seek to change an individual's sexual orientation or gender identity. (SD1)
Authorizes the DOH to establish fees for ground transportation to medical facilities and for provision of emergency medical services that do not include transport. Authorizes transportation by ambulance to medical facilities other than hospital emergency departments. Authorizes Medicaid programs to provide coverage for health care provided by emergency medical services personnel. (HB1453 CD2)
Requires and appropriates funds to the Department of Agriculture to partner with the Hawaii agricultural community to establish a Food Safety Certification Training Program to assist small to medium sized farms to comply with the United States Department of Agriculture Good Agricultural Practices Certification Program. Allows a class 18 small craft producer pub licensee to manufacture not more than 70,000 barrels of malt beverages on the licensee's premises during the license year. Clarifies that a class 14 brewpub licensee or class 18 small craft producer pub licensee may conduct certain activities at satellite locations other than the licensee's primary manufacturing premises under certain conditions. Part I: Purpose section. Part II: Establishes the strategic development programs revolving fund and transfers powers, duties, and programs of the Hawaii Strategic Development Corporation (HSDC) under Hawaii Technology Development Corporation (HTDC). Part III: Makes conforming amendments. Part IV: Repeals HSDC and transfers all duties, employees, rules, records, and equipment from HSDC to HTDC. Part V: Lowers the cap on the technology special fund and transfers unencumbered balances to the general fund. Part VI: Appropriates funds for HSDC to transfer assets and continue the strategic development programs within HTDC. (HB624 CD1)
