Provides that up to $50,000 per year in income earned and proceeds derived from stock options or stock by an employee from a qualified high technology business, as defined therein, or an investor who qualifies for a high technology business investment tax credit, shall be excluded from taxation, provided that amounts in excess of $50,000 in the taxable year shall be taxed at the applicable income tax rate. Restricts asset forfeiture to cases involving the commission of a covered criminal misdemeanor or felony offense. Requires seized property to be forfeited only when the property owner has been convicted of an underlying covered criminal misdemeanor or felony offense. Changes the standard of proof that the State must meet in order for property to be forfeited from "preponderance of the evidence" to "beyond a reasonable doubt". Requires the State to prove that owners consented to or possessed knowledge of the crime that led to the seizure of their property. Requires that the agency seizing the property pay for safe and secure storage of the seized property until the completion of the forfeiture proceeding or final disposition of the property. Directs any proceeds from a civil forfeiture to the general revenue fund for public education purposes. Repeals administrative forfeiture proceedings.
Requires that the department of accounting and general services be responsible for ensuring that the facilities under their responsibility are maintained in accordance with proper repair, maintenance, and cleanliness standards to promote the health and safety of occupants and visitors. (SD1)
Prohibits a creditor from initiating or continuing any action to garnish wages from a debtor during the period of an emergency proclamation in relation to the coronavirus disease 2019 pandemic and some time thereafter. Prohibits a creditor from garnishing more than ten per cent of a debtor's wages for six months thereafter. Effective 7/1/2050. Repeals 12/31/2021. (SD1)
Extends the renewal period from two years to four years for licensees who are seventy-two years of age or older but younger than eighty years of age; provided their driving record does not include two or more moving traffic violation convictions after the licensee attained the age of seventy-two years. Defines moving traffic violation. Takes effect 1/1/2050. (SD1)
Requires a court to sentence a person convicted of violating an injunction or restraining order or order of protection during the term of a stay-at-home order imposed by the State or a county in which the violation occurred to a mandatory minimum jail sentence of not less than thirty days and fined not less than $5,000.
Requires the office of enterprise technology services to establish policies, in collaboration with departments and agencies to, provide infrastructure and resources to permit authorized employees to securely access remote computing services. (SD1)
Amends provisions relating to criteria and procedures in family court determinations regarding custody and visitation rights. Clarifies that a parent's felony conviction for a violent or sexual offense in which the victim was a minor, or requirement to register as a sex offender, raises a rebuttable presumption that custody or visitation by that parent is not in the best interest of the child. Requires courts to consider registration as a sex offender a presumption of risk that affects the burden of producing evidence. Requires courts to state reasons for findings in writing or on the record, including specific findings that there is no risk to the child's health, safety, and welfare. Requires nondisclosure of certain information when a court makes a finding of abuse or domestic violence against a parent. (SD1)
Specifies that the amount of damages recoverable by a tenant subjected to an unlawful retaliatory eviction is equal to two months' rent. (SD1)
