RELATING TO THE ENVIRONMENT.

Requires for each draft environmental assessment and draft environmental impact statement a public hearing in the community directly affected by the underlying proposed action.

RELATING TO CONDOMINIUMS.

Amends the requirements for a condominium association's standard proxy form by deleting the option for a condominium owner to give the proxy to the board as a whole.

RELATING TO LAND LEASES.

Prohibits the State from leasing any public lands to any individual, corporation, or federal agency who is in arrears in the payment of taxes, rents, or other obligations owed to the State or any county. Prohibits the State from leasing any public lands, or extending the lease of any public lands, to any individual, corporation, or federal agency that is in arrears in the payment of certain moneys to the State, noncompliant with a consent decree or memoranda of agreement with the State that requires environmental maintenance or remediation with regard to the subject public lands, or convicted of a crime. Requires certification by the Office of the Governor before the issuance or extension of any federal lease that the individual, corporation, or federal agency is in good standing with the State. Provides that, if any existing lessee of public lands is found by the state agency managing the lease not to be in good standing with the State as of the effective date of this Act, the lessee shall have 3 years, or until the end of the lease term, whichever is sooner, to correct the violation or the lease shall be terminated.

RELATING TO LAND USE.

Authorizes county land use decision—making authorities to amend district boundaries involving certain land areas: (1) greater than fifteen acres, but not more than twenty-five acres, if the land areas are proposed for reclassification to the urban district, contiguous to an urban district, and at least sixty per cent of the land areas will be dedicated for the development of affordable housing; and (2) greater than thirty-five acres, but not more than fifty acres, if located in a county with a total land acre greater than four thousand square miles. Requires the counties to approve or deny applications for district boundary amendments within ninety days.

RELATING TO FAMILY COURT.

Requires certain persons to immediately report a potential tort claim to the family court when that person has reason to believe that a child in foster custody has suffered an injury that may give rise to a tort claim. Establishes procedures for the family court to allow a child in foster custody who has suffered an injury to seek outside legal representation for a claim of damages resulting from a tort.

RELATING TO PROTECTION OF STREAMS.

Prohibits dispositions that authorize diverting water from East Maui county streams for commercial purposes, except for existing water uses by the Maui County Department of Water Supply.

RELATING TO OCEAN RECREATION.

Amends penalties for violations of administrative rules governing boating and ocean recreation. Removes the environmental court's ability to suspend an individual's ability to operate or moor a vessel in state waters for violating an administrative rule.

RELATING TO UNDERGROUND FUEL STORAGE TANKS.

Prohibits the operation of all field-constructed storage tanks. Defines "field-constructed tank" to mean any tank constructed or manufactured in the field, including concrete tanks poured in the field or constructed in the field from steel or fiberglass.

RELATING TO SEARCH AND RESCUE.

Makes a person or entity liable for all or a portion of search or rescue expenses when the person or entity knowingly enters state, county, or private property, knowingly enters a hiking trail that is closed to the public, or violates applicable laws, provided that the closure is posted by sign, barricade, or other device that gives reasonable notice of the closure. Requires counties and the state fire council to adopt rules as necessary to pursue reimbursements.

RELATING TO THE LAND USE COMMISSION.

Requires each county to establish its own land use commission to make certain determinations under chapter 205, Hawaii Revised Statutes. Repeals the State Land Use Commission.
