Requires, when a defendant is convicted of negligent homicide in the first degree for causing the death of another while driving under the influence of drugs or alcohol, that victim restitution shall include financial support to raise the decedent's surviving minor children until each child reaches the age of eighteen, or until the age of twenty-three for any child who enrolls full-time in a college, university, vocational school, or trade school, in an amount to be determined by the court and to be paid to the person responsible for raising the children. Requires the Department of Human Services' Med-QUEST division to automatically transmit applicants' voter registration information to the Office of Elections and clerk of the county of the applicant's residence, subject to certain conditions. Authorizes the Office of Elections to designate state agencies for automatic voter registration if the agency collects, processes, or stores certain information. Updates methods for automatic voter registration conducted by the Examiner of Drivers. Makes conforming amendments. Effective 1/30/2026.
Requires managing agents for residential condominium properties with more than one hundred units located in a county with a population greater than 500,000 to possess a community association manager credential from a recognized nationwide community association management industry trade group. Requires a law enforcement officer who observes criminal misconduct by another law enforcement officer to report the criminal misconduct. Requires passage of a psychological screening test battery to qualify for appointment as a law enforcement officer. Subjects a law enforcement officer to denial, suspension, or revocation of a law enforcement officer's certification for failure to report observed criminal misconduct or committing an act of criminal misconduct. Prohibits the use of a chokehold by a law enforcement officer unless the use of deadly force is justifiable. Defines "chokehold".
Appropriates funds to the Department of Health for the Adult Mental Health Inpatient Program to secure contracts for the provision of forty psychiatric beds annually for the Hawaii State Hospital. Requires the Department of Health to include line-item funding for the Adult Mental Health Inpatient Program in its annual budget request beginning with fiscal year 2027-2028 to secure contracts for the provision of psychiatric beds for the Hawaii State Hospital.
Establishes a Child Welfare Services Branch (CWS) Oversight Commission within the Department of the Attorney General to review and assess case management procedures, training, staffing levels and other support given to CWS and address issues identified in the 2024 Auditor's Report on CWS and make recommendations on actions to reduce child harm and death and for legislation, funding, and other needs for CWS to support the goals of the Commission. Requires annual status reports to the Legislature. Dissolves the Commission on 6/30/2028. Appropriates funds.
Establishes notice requirements for employers under Hawaii's Workers' Compensation Law. Requires employers who deny the compensability of an employee's injury to submit a written report supporting the denial to the Director of Labor and Industrial Relations within a specified period. Requires employers to furnish to the injured employee up to $10,000 for medical care, services, and supplies for the period immediately following the injury and so long as reasonably needed or until the employer files a written report with the Director denying the compensability of the injury, whichever is earlier. Clarifies that failure to give an employer notice of an employee's injury does not bar a claim for compensation if any person having authority in the interest of the employer had knowledge of the injury.
Establishes the Shipping Container Inspection Program. Requires the Department of Law Enforcement to submit reports to the Legislature on implementation of the Shipping Container Inspection Program. Exempts employees of the Department of Transportation and DLE from personal liability under certain conditions. Requires any damages to container goods be borne by the State. Requires DLE and DOT to designate a site outside of the immediate port area to conduct inspections. Require the DLE to secure all illegal goods. Appropriates funds. Effective 7/1/2050. (SD1)
