RELATING TO ELECTRONIC SMOKING DEVICES.

Makes unlawful the sale of flavored products for electronic smoking devices, mislabeling of e-liquid products containing nicotine, and sale of tobacco products other than through retail sales via in-person exchange. Establishes penalties. Includes e-liquid and electronic smoking devices in the definition of "tobacco products" for purposes of the cigarette tax and tobacco tax law. Increases the license fee for wholesalers and dealers of tobacco products and retail tobacco permit fee. Requires retailers to pay an additional excise tax on the retail price of electronic smoking devices on and after 7/1/2021. Directs a certain percentage of moneys received from the cigarette tax and tobacco tax to the Hawaii tobacco prevention and control trust fund to establish and fund a comprehensive youth tobacco cessation program. Requires a person under twenty-one years of age who unlawfully purchases or possesses tobacco products, including electronic smoking devices, to complete a tobacco education or use cessation program or perform community service for a first offense. Repeals the electronic smoking device retailer registration unit. Repeals provisions relating to delivery of sales under the cigarette tax and tobacco tax law.

RELATING TO FIREARMS.

Prohibits a person from lending a firearm to a person who does not have a firearm permit or does not have a registered firearm. Requires an adult who is borrowing a firearm to have either a firearm permit or a registered firearm, and not be prohibited to own or possess a firearm. Specifies that an adult who is twenty-one years of age or older may be lent a rifle or shotgun for a period not to exceed twelve hours. Repeals the authorization to use a rifle or shotgun outside of the State for up to seventy-five days. Repeals the authorization to lend a rifle or shotgun without a permit.

RELATING TO SHARK PROTECTION.

Prohibits the importation of shark parts and products containing shark parts. Provides certain exemptions.

RELATING TO ELECTRONIC TRANSMISSION OF BALLOTS.

Provides that a voter with special needs shall be provided a means of electronic authentication of an electronic transmission of replacement ballot that does not include the voter's handwritten signature or a waiver of secrecy. Effective 5/1/2029. (SD1)

RELATING TO BUSINESS REGISTRATION.

Prohibits the Director of the Department of Commerce and Consumer Affairs from issuing certificates of good standing unless the entity has submitted a certificate of vendor compliance with its annual report certifies compliance with the Internal Revenue Service, Department of Labor and Industrial Relations, Department of Commerce and Consumer Affairs, and the Department of Taxation. Requires entities to submit certificates of vendor compliance as part of their annual reporting requirements.

RELATING TO THE LANDLORD-TENANT CODE.

Specifies that the amount of damages recoverable by a tenant subjected to an unlawful retaliatory eviction is equal to two months' rent. (SD1)

RELATING TO LAW ENFORCEMENT.

Establishes a private cause of action for persons injured by the deprivation of rights under the United States Constitution or the Hawaii Constitution by law enforcement officers. Requires that employers of law enforcement officers indemnify officers for judgments or settlements arising from that cause of action over a certain amount. Requires political subdivisions of the State who employ law enforcement officers to publicly disclose a list of officers against whom a judgment or settlement is entered as well as the amount of the judgment or settlement and any disciplinary actions or criminal charges brought against the officer.
