Prohibits the construction, modification, or expansion of any waste or disposal facility for hazardous waste or solid waste on land that is near or above a significant aquifer as determined by the Department of Health in consultation with the Commission on Water Resource Management. Effective 6/30/3000. (HD1)
Temporarily exempts affordable housing projects under certain circumstances from specific state and county fees and exactions related to discretionary approval or ministerial permitting, except fees and costs payable to the Hawaiʻi Housing Finance and Development Corporation and the rates and fees of the various boards of water supply. Repeals 6/30/2028. Effective 6/30/3000. (HD2)
Requires the Public Access Room to establish and maintain an outreach and engagement program for primary, secondary, post-secondary, and community education and appropriates funds for one full-time equivalent (1.0 FTE) position to assist in effectuating this requirement. Requires the Department of Education and University of Hawaiʻi to assign appropriate staff to coordinate with the Public Access Room with respect to the outreach and engagement program. Removes from the standard condominium proxy form the option of giving a proxy vote to the board of directors of a condominium association as a whole. Removes the authority of a board to use association funds to solicit proxies as part of the distribution of proxies.
Gives the Office of Information Practices the discretion to resolve disputes about open records or open meetings either through an opinion or, when the opinion would likely be in favor of the agency, through informal written guidance. Appropriates funding for the Office of Information Practices to hire two new full-time positions for a Legal Assistant and Attorney.
Establishes the natural resource management special fund and authorizes uses for moneys in the fund. Establishes a Natural Resource Management Commission to guide and approve the disbursement of moneys deposited into the fund. Allocates transient accommodations tax revenues to the natural resource management special fund. Allocates transient accommodations tax revenues to the Hawaiʻi Tourism Authority. Repeals the allocation of transient accommodations tax revenues to the special land and development fund. Appropriates moneys for the natural resource management special fund and for operating expenses of the Hawaiʻi tourism authority.
Amends the definition of "dangerous to self" as used in State law governing mental health, mental illness, drug addiction, and alcoholism. Defines the terms "gravely disabled" and "psychiatric deterioration". Broadens the term of "imminently dangerous to self and others" to persons who will likely be dangerous to self or to others within the next ninety days, rather than within the next forty-five days. Increases the maximum period of emergency hospitalization from forty-eight hours to seventy-two hours.
Requires certain patients subject to emergency hospitalization to be assessed to determine whether a surrogate or guardian is needed to make appropriate health care decisions for the patient.
Authorizes the School Facilities Authority of the Department of Education to disregard any ordinance or rule related to the use, zoning, planning, or development of land to which the authority holds title or for any construction on land to which the authority holds title.
