RELATING TO THE MODERNIZATION OF CRIMINAL JUSTICE.

Defines serious crime as murder or attempted murder in the first degree or class A felony, or a call B or C felony involving violence of threat of violence. Allows the court to determine if bail may be denied where the charge is for a serious crime. Requires the judicial council to appoint a committee to review and recommend changes to the Hawaii penal code. Takes effect 7/1/25. (SD1)

RELATING TO STATEWIDE COMPOSTING.

Requires the department of health to periodically update its cocomposting rules. Requires department of health to establish a multi-tiered registration and permitting system for composting facilities. Allows composting and co-composting in agricultural districts. (SD1)

RELATING TO HOUSING.

Lowers conveyance tax rates for properties with a value under $2,000,000. Increases conveyance tax rates for investment properties with certain exceptions. Requires a percentage of conveyance taxes collected to be deposited into the housing finance revolving fund. Effective 1/1/2022. (SD1)

RELATING TO SPEEDY TRIALS.

Creates a statutory right of victims and witnesses of sexual offenses under part V of chapter 707, Hawaii Revised Statutes, to a speedy trial in criminal cases involving adult defendants. Requires the court and the prosecution to take appropriate action to ensure a prompt trial in order to minimize the length of time a child abuse victim or minor witness must endure the stress of the proceedings. Effective 5/1/2029. (SD1)

RELATING TO THE LAW OF THE SPLINTERED PADDLE.

Prohibits a county from enacting any ordinance that prohibits a person from lying by the roadside in safety in accordance with the law of the splintered paddle. (SD1)

RELATING TO WAGE GARNISHMENT.

Prohibits a creditor from initiating or continuing any action to garnish wages from a debtor during the period of an emergency proclamation in relation to the coronavirus disease 2019 pandemic and some time thereafter. Prohibits a creditor from garnishing more than ten per cent of a debtor's wages for six months thereafter. Effective 7/1/2050. Repeals 12/31/2021. (SD1)
