RELATING TO THE OFFENSE OF ABUSE OF FAMILY OR HOUSEHOLD MEMBERS.

Establishes that the offense of abuse of a family or household member is a petty misdemeanor with a jail sentence of no less than forty-eight hours and no more than thirty days. Establishes that for a second offense that occurs within five years of the first conviction of the offense of abuse of a family or household member is a misdemeanor and the person shall be termed a "repeat offender". Establishes that a third or subsequent offense that occurs within five, rather than two, years of a second or subsequent conviction of the offense is a class C felony. Allows the prosecution to use prior convictions of the offense of abuse of a family or household member as evidence in the instant offense committed by a repeat offender. Requires that court ordered domestic violence intervention programs include anger management training. Requires the judiciary, in cooperation with the prosecutor of each county and police department of each county, to annually compile and report on statistics regarding arrests, charges, and convictions based on the offense of abuse of a family or household member. Repeals and reenacts the offense of abuse of a family or household member on 06/30/20.

RELATING TO THE CODE OF ETHICS.

Clarifies the fair treatment law by delineating limitations placed on persons who are task force members from those placed on legislators who are task force members. Clarifies that legislators are not prohibited from making statements or taking action in the exercise of their legislative functions. (HB98 HD1)

RELATING TO MARINE EVENTS.

Requires a permit from the Department of Land and Natural Resources before holding a regatta, marine parade, or surfing contest. Requires permit applications to be submitted up to one year and at least forty-five days before the start of the proposed event. Allows DLNR to assess and collect a fee for permit processing. Requires DLNR to collect a deposit that is nonrefundable if the event is canceled within sixty days of the start of the event. Effective 7/1/2050. (SD1)

PROPOSING AN AMENDMENT TO ARTICLE I, SECTION 2, OF THE CONSTITUTION OF THE STATE OF HAWAII TO INCLUDE ACCESS TO CLEAN DRINKING WATER, EDUCATION AND HEALTH CARE AMONG THE INHERENT AND INALIENABLE RIGHTS OF INDIVIDUALS.

Proposes a constitutional amendment to ensure access to clean drinking water, meaningful health care, and a quality education are among the inherent and inalienable rights of individuals. (HB1582 HD1)

RELATING TO HOMEOWNERS' ASSOCIATIONS.

Expands the law on planned community associations to apply to certain homeowners' associations. Clarifies that if a proxy is a standard proxy form authorized by an association, and the proxy is returned with no box checked or more than one box checked, the proxy shall be counted for quorum purposes only. RELATING TO CEMETERIES.

Limits liability for persons maintaining or repairing cemetery grounds. Requires the director of commerce and consumer affairs, in consultation with the comptroller, to develop strategies for repair and maintenance of Sunset Memorial Park in Pearl City, Oahu. Requires report to Legislature. Takes effect 1/7/2059. (SD2)
