RELATING TO THE HAWAII PUBLIC PROCUREMENT CODE.

Establishes a working group within the department of accounting and general services to study and recommend to the legislature improvements to the management of the state procurement office and methods of procurement, particularly in the area of natural resource management. Requires a report prior to the convening of the regular session of 2023.

RELATING TO STATE PROCUREMENT REFORM.

Requires procurement officers to document whether to pursue a design professional or contractor for damages in the event of construction cost overruns. Makes cost overruns a construction defect for the purposes of the contractor repair act. Requires the state procurement office to include training on the duty of procurement officers to hold design professionals liable for breaches of professional standards. Requires the state procurement office to conduct a study on the appropriateness of a liability contingency fund for cost overruns in bids for state contracts and report to the legislature. Establishes a procurement professional standards task force. Appropriates funds. Effective 7/1/2112. (HD1)

RELATING TO ENERGY INTERCONNECTION.

Directs the public utilities commission to adopt guidelines for interconnection applications that would trigger distribution, transmission, or other utility infrastructure upgrade costs in excess of a threshold determined by the commission. Effective 7/1/2100. (HD1)

RELATING TO THE BOARD OF EDUCATION.

Requires the board of education to hold no less than six community forums annually, with at least one forum in each county. Makes board member attendance at community forums permitted interactions under certain circumstances. Requires the board to include an open forum for public comments on non-agenda items. Requires a report to the legislature on implementing open forums at board of education meetings. (HD1)

RELATING TO TAX CREDIT FOR ON-SITE EARLY CHILDHOOD FACILITIES.

Establishes an income tax credit for employers who create on-site early childhood facilities, to be applicable to taxable years beginning after 12/31/2022. Establishes and appropriates funds for an on-site early childhood facility coordinator position. Effective 7/1/2050. (HD1)

RELATING TO ENVIRONMENTAL IMPACT STATEMENTS.

Requires the Office of Planning and Sustainable Development to establish, implement, and maintain an interactive website that is accessible by the public at no cost and provides notification of and opportunity for participation in actions taken pursuant to the State's environmental review process. RELATING TO HEALTH.

Creates the Hawaii rural mental health corps program and Hawaii rural mental health care provider loan repayment program to encourage psychologists and social workers to serve in counties having a shortage of psychologists and social workers. PROPOSING AN AMENDMENT TO ARTICLE I OF THE CONSTITUTION OF THE STATE OF HAWAII TO RECOGNIZE AND PROTECT THE INHERENT AND INALIENABLE RIGHT OF ALL PEOPLE TO CLEAN WATER AND AIR AND HEALTHY ECOSYSTEMS, INCLUDING CLIMATE, AND TO THE PRESERVATION OF THE NATURAL, CULTURAL, SCENIC, AND HEALTHFUL QUALITIES OF THE ENVIRONMENT.

Proposes a constitutional amendment that recognizes that the fundamental right of all people, including future generations, to clean water and air, a healthful environment and climate, and healthy native ecosystems and beaches shall be protected and shall not be infringed.
