RELATING TO THE TRANSFER OF NON-AGRICULTURAL PARK LANDS.

Before the transfer of non-agricultural park lands, authorizes the Department of Agriculture to request information from the Department of Land and Natural Resources related to the establishment of necessary and reasonable easements upon the lands. Amends legislative findings regarding non-agricultural park lands. Requires the Department of Agriculture to accept the transfer of and manage certain qualifying non-agricultural park lands. Requires the Department of Agriculture, prior to offering a lease, to inquire with the Department of Land and Natural Resources regarding any easements required for access to landlocked forest reserves or other assets on the lands subject to the lease. Continue to require the lessee to maintain a conservation plan. Requires approval from the Board of Land and Natural Resources and the Board of Agriculture before removing pasture lands for reforestation, or other public purposes.

RELATING TO TRESPASSING.

Authorizes the court to elevate the offense of criminal trespass in the first degree from a misdemeanor to a class C felony if the court deems the trespassing to be egregious or repeated.

RELATING TO SELF-DEFENSE.

Clarifies that a person who uses deadly force in self-defense does not have a duty to retreat if they are in their dwelling or on their property unless they are the initial aggressor. Repeals statutory language that permits a person to use deadly force at their place of work.

RELATING TO CANNABIS.

Establishes the Hawaiʻi Cannabis Authority and Cannabis Control Board within the Department of Commerce and Consumer Affairs to regulate all aspects of the cannabis plant. Beginning January 1, 2026, legalizes the personal adult use of cannabis. Establishes taxes for adult-use cannabis sales. Transfers the personnel and assets of the Department of Health and assets Department of Agriculture to the Hawaiʻi Cannabis Authority. Appropriates funds.

RELATING TO CRIME.

Requires special sentencing of habitual violent felons. Requires the Department of Law enforcement, in collaboration with the Statewide Office on Homelessness and Housing Solutions, to work with Weed & Seed Hawaiʻi, Inc., to expand Weed & Seed Hawaiʻi, Inc.'s site programs statewide, beginning with the Waianae Coast of Oahu.

Appropriates funds to the University of Hawaiʻi Cancer Center to conduct a multiethnic cohort study focusing on the social determinants of health, lifestyles, environmental exposures, and resilience factors of Native Hawaiians, Pacific Islanders, and Filipinos. Requires the Cancer Center to seek federal funding to complete the study.
