RELATING TO RESTORATIVE JUSTICE.

Requires the judiciary or supporting agencies to establish and support a program for restorative justice in each county and inform various criminal justice representatives of the existence of the program. Appropriates funds.

RELATING TO THE PHASEOUT OF PRIVATE CORRECTIONAL FACILITIES.

Requires the Hawaii correctional oversight commission to create a comprehensive plan to phase out the use of private correctional institutions by 2025. Prohibits the construction of new correctional facilities and the expansion of existing correctional facilities without first obtaining input and recommendations of the Hawaii correctional system oversight commission. Effective 7/1/3050. (HD1)

RELATING TO STREAM PROTECTION.

Prohibits BLNR from approving dispositions that authorize or have the effect of authorizing the diversion of water from streams except under specified criteria. Deposits moneys collected via land dispositions that authorize or have the effect of authorizing the diversion of water from streams into the forest stewardship fund.

RELATING TO CAMPUS SAFETY.

Requires UH to provide training on the impacts of trauma for employees responsible for investigating incidents and assisting victims of sexual and domestic violence. Improves access for confidential support services. Requires UH to annually distribute information about sexual and domestic violence prevention and disclosure protocols to students and employees. To the extent possible, requires a private college or university to implement identical campus safety and accountability standards to those applicable to UH.

RELATING TO THE MODERNIZATION OF CRIMINAL JUSTICE.

Eliminates the use of monetary bail, with certain exceptions, and requires defendants to be released on their own recognizance for traffic offenses, violations, non-violent petty misdemeanor offenses, and non-violent misdemeanor offenses. Creates a rebuttable presumption regarding both release and detention for certain offenses and specifies circumstances in which these presumptions apply. Requires the judicial council to appoint a committee to review and recommend changes to the Hawaii penal code.

RELATING TO SEX TRAFFICKING PREVENTION.

Requires the department of education to offer training for teachers, educational officers, and school-based behavioral health specialists on sex trafficking prevention and response.

RELATING TO CHARTER SCHOOLS.

Requires charter school authorizers to provide a list of approved independent auditors, rather than selecting three independent auditors, from which their respective charter school is to select an independent auditor for its annual financial audit. Effective 7/1/2050. (HD1)

RELATING TO LAW ENFORCEMENT.

Establishes an enforcement division in the department of the attorney general. Transfers to the department of the attorney general enforcement division the law enforcement activities of the department of land and natural resources, division of conservation and resources enforcement; the department of public safety state law enforcement officers and the narcotics enforcement division; and the department of transportation harbors division. Specifies the persons authorized to serve civil legal process. Mandates the attorney general to maintain a list of independent civil process servers. Shields the State and the department of the attorney general from liability arising from the acts of independent civil process servers. Effective 7/1/2022.

RELATING TO ECONOMIC DIVERSIFICATION.

Establishes the Hawaii 2030 economic diversification task force to develop a plan to diversify the State's economy by 2030. Requires the task force and the auditor to submit reports to the legislature.

RELATING TO FARM TO SCHOOL PROCUREMENT.

Requires the department of education to establish rules for the procurement of goods and services related to the administration of food programs at public schools that incorporate a geographic preference for unprocessed locally grown and locally raised food products. Effective 7/1/2051. (HD2)
