RELATING TO PREFERENCES UNDER THE PROCUREMENT CODE.

Establishes a preference under the procurement code for employers who pledge to hire individuals with disabilities when contracting for goods, services, or construction through competitive sealed bidding, competitive sealed proposals, or both.

RELATING TO REVENUE GENERATION.

Increases the personal income tax rate and implements a rate recapture mechanism that phases out lower tax brackets for high earners for taxable years beginning after 12/31/2020. Increases the tax on capital gains. Increases the corporate income tax and establishes a single corporate income tax rate. From 7/1/2021 through 6/30/23, temporarily repeals certain general excise tax exemptions. Increases conveyance taxes for the sale of properties valued at $1,000,000 or greater.

RELATING TO EMPLOYMENT SECURITY.

Sets the employer contribution rate for small business employers for calendar years 2021 and 2022 at an unspecified schedule. Defines "small business employer". Applies retroactively to 01/01/21.

RELATING TO TAXATION.

Amends the rate of the environmental response, energy, and food security tax imposed on petroleum products. Amends the portion of environmental response, energy, and food security tax revenues deposited into the energy security special fund.

RELATING TO CASINO GAMING.

Grants 10-year license for 1 stand-alone, members-only casino in Waikiki, not in a hotel. Allows guests 21 years of age or older who register to stay 1 day and night at a hotel on Oahu for each day of admission at $20-per-day pass. Establishes the Hawaii gaming control commission. Imposes wagering tax on gross receipts. Creates the state gaming fund and compulsive gambler program.

RELATING TO VICTIM-COUNSELOR PRIVILEGE.

Expands the victim-counselor privilege under Rule 505.5 of the Hawaii Rules of Evidence to include victims of dating violence, stalking, and sexual harassment and confidential advocates employed by the University of Hawaii. Effective 7/1/2060. (HD2)

RELATING TO ANIMAL CRUELTY.

Prohibits specified trolleys, trolleys with swivels, pulleys, cables, or running lines designed to attach a dog to two stationary objects in a configuration that endangers the dog, including by depriving the dog of sustenance. Prohibits tethering or restraining a dog under the age of six months unless the dog is engaged in an activity supervised by its owner or an agent of its owner. Prohibits tethering or restraining a dog with a tow or log chain. Prohibits tethering or restraining a dog with a choke collar, pinch collar, or prong collar unless the dog is engaged in an activity supervised by its owner or an agent of its owner.

RELATING TO INSPECTIONS OF CARE FACILITIES.

Specifies that plans of correction and the status of corrective actions for care facilities shall be added to reports by the department of health within five working days. Clarifies, for reporting purposes, that the conclusion of an inspection occurs after the initial visit to a facility is completed.
