Establishes a moratorium on the construction of any new correctional facilities in the State from 7/1/2021 to 6/30/2022, including the planned construction of a new facility to replace the existing Oahu community correctional center. Prohibits the construction of new correctional facilities or the expansion of existing correctional facilities without the department of public safety first obtaining the input of and recommendations from the Hawaii correctional system oversight commission on any master plan for the facility, and the inclusion of the commission's input and recommendations in any environmental impact statement for the project. Clarifies that the department of public safety retains custody of and jurisdiction over any Hawaii inmate who has been transferred to and is incarcerated at a correctional institution located outside of the State. Provides that the department of public safety may transfer any Hawaii inmate who was transferred to an out-of-state institution back to the State at any time and for any reason. Requires Hawaii inmates incarcerated outside of the State to be afforded all rights and privileges available to inmates incarcerated at correctional institutions located within the State. Allows persons with a mental illness to participate in the vending facilities program. Limits vending facilities owned or operated by persons with mental health disorders to only those state or county public buildings not currently occupied by blind or visually handicapped vendors.
Requires a personal representative of a decedent appointed under the Uniform Probate Code to notify the police department of the appropriate county of any and all firearms in an estate. Requires the police department to certify that all registered firearms in an estate and other firearms of which the police department has been notified are properly transferred or disposed of before the estate may close.
Establishes a telework tax credit for employers who allow telework for at least thirty per cent of their employees. Applies to taxable years beginning after 12/31/20.
Eliminates the use of monetary bail and requires defendants to be released on their own recognizance for traffic offenses, violations, and nonviolent petty misdemeanor and misdemeanor offenses, with certain exceptions. Creates rebuttable presumptions regarding release and detention for certain offenses and specifies circumstances in which these presumptions apply.
Requires the department of land and natural resources, in conjunction with the counties, to develop an invasive species flood control plan to prevent, contain, and mitigate hazardous tree growth impacting streams and waterways. Requires submittal of the plan to the legislature prior to the 2022 regular session.
Authorizes the board of land and natural resources to provide shoreline encroachment easements that do not exceed 10 years to landowners having structures that encroach on the shoreline. Requires the board of land and natural resources to adopt rules that establish a policy and procedure for the granting or renewal of shoreline encroachment easements. Requires the adopted policy to consider the impact of expected sea level rise on the encroaching structures. Prohibits the granting of any new shoreline encroachment easements until the new policy is adopted.
Specifies the documentation needed for a military spouse to receive a temporary licensure by endorsement. Requires issuance of the license within 30 days of the application and supporting documents.
