RELATING TO COMMERCIAL OCEAN RECREATION OPERATIONS.

Specifies that the Department of Land and Natural Resources shall issue all new commercial use permits for commercial ocean recreation activity in an ORMA that are not renewals or reissuances by public auction. Revises provisions relating to boating and ocean recreation fees and permits. Effective 7/1/3000. (HD1)

RELATING TO CRIME.

Clarifies that the areas appurtenant to a multi-unit dwelling that are restricted to residents are included as dwellings for the purposes of prosecuting offenses under burglary in the first degree. Allows the owner of a multi-unit building, owner of an individual unit, property manager, or an authorized representative of the condominium association to act as a complainant for the purpose of investigating and prosecuting a burglary in the first degree in a multi-unit building. RELATING TO HEMP.

Makes imposition of the fine penalty applicable to any violation of the commercial hemp production licensure requirement as well as restrictions on growing and transporting hemp. Repeals the requirement for additional rules by the Department of Agriculture to address nuisance issues, including smell, noise, and excessive lighting arising out of the activities of hemp growers. Clarifies that the Department of Agriculture shall not require testing or sampling of hemp that duplicates testing and sampling required by the United States Department of Agriculture. Includes the prevention of activities within an applicant's premises and adjacent areas that are potentially injurious to the health, safety, and welfare of the public and neighborhood as a factor for determining whether a controlled substances registration is in the public interest. RELATING TO TAXATION.

Amends the definition of Hawaiʻi taxable estate to provide that the marital deduction under section 2056 of the Internal Revenue Code shall apply to the passage of any interest in property to any immediate family member. Effective 7/1/3000. (HD1)

RELATING TO PARTIAL PUBLIC FINANCING OF ELECTIONS.

Increases the amount of partial public campaign financing available for all elective offices. Adjusts the minimum amount of qualifying contributions certain candidates must receive to participate in the program. Increases the matching fund payments for excess qualifying contributions. RELATING TO THE UNIVERSITY OF HAWAII RESIDENT TUITION FEE.

Requires the tuition residency rules for the University of Hawaiʻi to grant the resident tuition fee for enrollment at any University of Hawaiʻi campus to individuals who have graduated from a Hawaiʻi high school and are enrolling in an undergraduate degree program, under certain conditions.
