RELATING TO HISTORIC PRESERVATION.

Redefines "historic property" with respect to the State Historic Preservation Program. Deletes the requirement for an application for a proposed project on an existing privately-owned single-family detached dwelling unit to have a historic preservation review if the unit or townhouse is over fifty years old.

RELATING TO LAND LEASES.

Prohibits the State from leasing any public lands, or extending the lease of any public lands, to any individual, corporation, or federal agency that is in arrears in the payment of certain moneys to the State, is noncompliant with a consent decree or memoranda of agreement with the State that requires environmental maintenance or remediation with regard to the subject public lands, or has been found to be in violation of federal or state laws aimed at protecting the environment. Requires certification by the Office of the Governor before the issuance or extension of any federal lease that the individual, corporation, or federal agency is in good standing with the State. Provides that, if any existing lessee of public lands is found not to be in good standing with the State as of the effective date of this Act, the lessee shall have three years, or until the end of the lease term, whichever is sooner, to correct the violation or the lease shall be terminated. RELATING TO CANNABIS.

Establishes the Hawaii Cannabis and Hemp Office within the Department of Commerce and Consumer Affairs to regulate all aspects of the cannabis plant. Beginning 1/1/2026, legalizes the personal adult use of cannabis. Establishes taxes on the retail sale of adult-use cannabis and the sale of medical cannabis. Adds new traffic offenses relating to the consumption or possession of marijuana or marijuana concentrate. Makes conforming amendments related to the legalization of personal adult use of cannabis. Beginning 1/1/2026, decriminalizes certain drug offenses related to marijuana and marijuana concentrate. Transfers the personnel and assets of the Department of Health and assets of the Department of Agriculture relating to cannabis to the Hawaii Cannabis and Hemp Office. Establishes various positions within state entities to regulate the personal adult use of cannabis. Appropriates funds. Effective 7/1/3000. (HD1)

RELATING TO DISASTER PREPAREDNESS.

Requires all public buildings, including public school buildings, constructed after January 1, 2026, to be designed to withstand category five hurricanes and be used as shelters in the event of an emergency. Effective 7/1/3000. (HD1)

RELATING TO AGRICULTURAL TOURISM.

Requires the counties to adopt ordinances setting forth procedures and requirements for the review and permitting of agricultural tourism uses and activities as secondary uses, in addition to accessory uses, on a working farm or farming operation. Requires the counties' ordinances to include requirements that: the principal agricultural use on a working farm or farming operation preexists the issuance of any land use permit or building permit for any accessory and secondary use and agricultural tourism be allowed only on land on which productive agricultural use is occurring. Effective 7/1/3000. (HD1)

RELATING TO TEACHER COMPENSATION.

Recognizes prior teaching experience at an equal salary rating for teachers entering or reentering into the service of the Department of Education. Effective 7/1/3000. (HD1)

RELATING TO LANDLORD-TENANT DISPUTES.

Requires the Judiciary to contract for legal services for residential tenants in actions or proceedings for possession under certain circumstances. Authorizes attorneys, paralegals, and law students to provide legal services to residential tenants. Appropriates funds. Effective 7/1/3000. (HD1)

RELATING TO HOUSING.

Requires, for tenancies greater than 90 days, a landlord to notify a tenant of any intent to raise the rent for any subsequent rental agreement or any intent to terminate a rental agreement 60 days before the expiration of the original rental agreement. Requires 90 day's notice for a landlord or tenant to terminate tenancies of three years or more and 60 days' notice to terminate tenancies of less than three years, with certain exceptions. Increases the amount of notice required to terminate tenancies that are less than month-to-month. Effective 7/1/3000. (HD1)

RELATING TO COMMUTING.

Requires the Director of Human Resources Development, in consultation with the Hawaii Climate Change Mitigation and Adaptation Commission, Hawaii State Energy Office, and Department of Accounting and General Services, to develop and implement a comprehensive Commuting Choice Benefit Program for all state employees regardless of mode of transportation. Requires a report to the Legislature. Appropriates funds. Effective 7/1/3000. (HD1)
