RELATING TO TRANSPORTATION.

Beginning 7/1/2024, subjects all electric vehicles to a state mileage-based road usage fee instead of paying a registration surcharge. Requires a vehicle inspection certificate to state the odometer reading of the vehicle. Clarifies that the type of fuel required on applications for vehicle registration includes batteries or electricity. Requires the department of transportation to develop a long-term mileage-based usage fee implementation plan for all passenger vehicles and light duty trucks by 2033. Requires the department of transportation to seek federal funding. Appropriates American Rescue Plan Act funds for the state mileage-based road usage fee program.

RELATING TO THE DEPARTMENT OF HAWAIIAN HOME LANDS.

Permits the Department of Hawaiian Home Lands to appoint independent counsel in certain circumstances. Requires the Department to amend its administrative rules accordingly.

RELATING TO SCHOOLS.

Requires the board of education to adopt rules to expand the jurisdiction of all public schools under the purview of the department of education to include a quarter-mile radius surrounding each public school.

RELATING TO ENVIRONMENTAL PROTECTION.

Establishes a list of substances allowed for use as pesticides and fertilizers on state and county property. Provides that the use of substances not specifically allowed as pesticides and fertilizers on state property and county property is prohibited, unless certain exceptions, a waiver, or exemption apply. Requires a state department or agency seeking a waiver to apply to the department of agriculture.

RELATING TO AN INCOME TAX CREDIT.

Establishes a two-year nonrefundable individual income tax credit for expenses paid to retrofit a residence with wind resistive devices. Applies to taxable years beginning after 12/31/2023. Sunsets 12/31/2025. Effective 6/30/3000. (HD1)

RELATING TO FENTANYL TEST STRIPS.

Excludes from the definition of "drug paraphernalia", testing products utilized in determining whether a controlled substance contains chemicals, toxic substances, or hazardous compounds in quantities that can cause physical harm or death, including but not limited to fentanyl test strips. Defines "fentanyl test strip". (SD1)

RELATING TO NATURAL RESOURCES.

Requires the commission on water resource management and division of aquatic resources of the department of land and natural resources, in partnership with the University of Hawaiʻi and department of health, to conduct research on limu to understand the impacts of groundwater use on groundwater-dependent ecosystems. RELATING TO RENEWABLE ENERGY.

Requires government entities in the State that issue building permits to implement SolarAPP+ or a functionally equivalent online automated permitting platform that verifies code compliance and issues permits to licensed contractors for solar distributed energy resource systems in real time by 1/1/2024. Requires government entities in the State that issue building permits to adopt self-certification for solar distributed energy resource systems of 250 kilowatts or less that are not SolarAPP+ compatible. Makes the professional engineers, architects, surveyors, and landscape architects licensure law inapplicable to work with respect to residential distributed energy resource systems and increases the estimated cost of work on certain structures below which that licensure law is inapplicable. RELATING TO THE BOARD OF EDUCATION.

Requires the Board of Education to hold not less than six community forums annually, with at least one community forum in each county. Requires the Board to include an open forum for public comments on non-agenda items. Requires a report to the Legislature on implementing open forums.

RELATING TO LEASEHOLD CONVERSION.

Excludes from taxation one hundred per cent of the gain realized by a fee simple owner from the sale of a leased fee interest in units within a condominium project, cooperative project, or planned unit development to the association of apartment owners or the residential cooperative housing corporation of the leasehold units. Applies to taxable years beginning after 12/31/2022 and does not apply to taxable years beginning after 12/31/2029. Effective 7/1/3000. (HD1)
