Includes the use of traditional Native Hawaiian burial practices in the treatment and disposal of human remains, including the use of alkaline hydrolysis. Requires the Department of Health to adopt rules.
Decriminalizes the act of engaging in, or agreeing or offering to engage in, sexual conduct with another person in return for a fee or anything of value. Authorizes civil claims to be made against a business, owner or operator of a transient accommodation, or other commercial entity that profits from sexual exploitation. Converts the human trafficking victim services fund to a human trafficking reparations fund.
Prohibits contractors from offering to pay insureds' property or casualty insurance deductibles as incentives to induce the insureds to hire the contractors. Allows insureds to rescind contracts with the contractors within five business days after the date the contract is executed. Requires contractors to provide certain forms to an insured, prior to entering into a contract. Prohibits contractors from representing or negotiating, or offering or advertising to do so, on behalf of an insured in an insurance claim. Specifies violations are unfair methods of competition and unfair or deceptive acts or practices.
Beginning 01/01/2023, adds the gender marker "X" as a third gender option on birth certificates and permits individuals to submit an application for a change in sex designation on their birth certificates that reflects this third gender option.
Establishes a pilot program in the department of public safety to hire five social workers to accompany officers on incidents involving persons that may suffer from substance addiction, mental illness, homelessness, or other catastrophic afflictions. Appropriates funds.
Prohibits commercial vehicles from making pickups from, or deliveries to, business establishments during certain times of the day and within a certain proximity of single-family residences in the performance of the vehicles' pickup or delivery. Establishes fines.
Clarifies that access to abortion care is inclusive of all pregnant people in the State. Repeals a criminal penalty for violations of certain abortion provisions. Clarifies that advanced practice registered nurses may provide abortion care.
Establishes noise generated by helicopters in excess of a certain decibel level constitutes a public nuisance and a source of noise pollution in violation of the State's noise pollution law. Establishes fines and a private right of action for individuals to sue helicopter owners and operators for committing a public nuisance.
Requires the Hawaii housing finance and development corporation to establish the kauhale program to provide individual or shared micro housing units and services to homeless individuals and families who meet the definition of chronically homeless or are currently homeless. Requires reports to the legislature. Appropriates funds.
Legalizes, regulates, and taxes cannabis and manufactured cannabis products for responsible, adult use. Exempts sales of cannabis and manufactured cannabis products for medical use from the general excise tax. Clarifies that qualifying out-of-state patients have the same rights and privileges under the medical cannabis law. Allows qualifying out-of-state patients to cultivate medical cannabis.
