Stop Militarizing Law Enforcement Act This bill restricts the Department of Defense (DOD) from transferring certain surplus military property to federal, state, or local law enforcement agencies. Specifically, DOD may not transfer to such agencies specified property such as controlled firearms, ammunition, grenade launchers, explosives, certain vehicles or trucks, armored or weaponized drones, certain controlled aircraft, silencers, or long-range acoustic devices. DOD may waive this limitation and transfer certain vehicles or trucks if DOD determines that the transfer is necessary for disaster or rescue purposes or for another purpose where life and public safety are at risk. As a condition for a transfer of allowable property, DOD must require the federal or state agency that receives the property to return the property if the agency is investigated by the Department of Justice for civil liberties violations or is otherwise found to have engaged in widespread abuses of civil liberties. DOD must also periodically submit certain transfer-related information and certifications to Congress. Furthermore, as a condition for transfer, the recipient must receive the approval of its local governing body, provide specified notice to the local community, and submit specified information and certifications to DOD. A federal or state agency that receives controlled property under such a transfer may never take ownership of the property. The bill also eliminates the requirement for DOD to give preference to transfers of property that will be used in counter-drug, counterterrorism, disaster-related emergency preparedness, or border security activities.

This resolution repeals the authority for Members of the House of Representatives to conduct remote voting by proxy and remote committee activity.

Immigration Detainer Enforcement Act of 2021 This bill expands statutory provisions to authorize the Department of Homeland Security (DHS) to request a law enforcement agency to detain an individual who has been arrested for violating any law (if the individual is believed to be an unlawfully present alien), where current provisions only explicitly authorize detainer requests for individuals arrested for violating controlled substances laws. The bill also modifies other related provisions. A law enforcement agency that has received a detainer request may hold the targeted individual for up to 48 hours. DHS may enter into agreements with law enforcement agencies to indemnify such agencies against claims for wrongful detention resulting from a detainer request. No provision of federal, state, or local law may restrict any government entity from (1) providing DHS with access to databases with information relating to issued detainers, or (2) holding an individual subject to a detainer. DHS shall periodically certify to Congress as to which state or local entities have not complied with a detainer request. Such entities shall be ineligible for compensation for costs related to honoring detainer requests. State and local entities that comply with DHS detainer requests shall have prioritized access to (1) certain law enforcement-related grants, and (2) certain excess federal property.

Hong Kong Safe Harbor Act This bill designates certain Hong Kong residents with priority status for refugee consideration and contains other related provisions. An individual and certain family members shall have such priority status if the individual (1) is a Hong Kong resident who suffered persecution or has a well-founded fear of persecution as a result of peaceful political activity; or (2) has been formally charged, detained, or convicted for certain peaceful actions. An individual receiving refugee status under this bill shall not be counted against various numerical limitations. When determining whether an individual shall be admitted as a refugee under this bill, an individual whose citizenship, nationality, or residency was revoked for submitting a nonfrivolous application for a U.S. immigration benefit shall be considered to have suffered persecution on account of political opinion. The general presumption that an alien is seeking immigrant status shall not apply to certain Hong Kong residents seeking asylum into the United States. (Typically, an alien seeking admission as a nonimmigrant must establish that the alien does not intend to immigrate to the United States.) This exception to the presumption shall apply to certain individuals involved in the 2019 and 2020 protests against China's encroachment into Hong Kong's autonomy (Hong Kong is a part of China but has a separate legal and economic system). An individual from Hong Kong may not be denied admission into the United States if the primary reason for the denial is a politically motivated government action against the individual's involvement in protests.

This joint resolution proposes an amendment to the Constitution to require that the Supreme Court consist of nine Justices.

Protecting the Right to Keep and Bear Arms Act of 2021 This bill prohibits (1) the President or the Department of Health and Human Services from declaring emergencies or disasters for the purpose of imposing gun control; and (2) a federal officer or employee, or person operating under color of federal law, from banning the manufacture, sale, or transfer of firearms or ammunition while acting in support of relief from a major disaster or emergency.

Federally Integrated Species Health Act or the FISH Act This bill gives the Fish and Wildlife Service (FWS) the sole authority to protect endangered or threatened species that are anadromous species (species of fish that spawn in fresh or estuarine waters and that migrate to ocean waters) or catadromous species (species of fish that spawn in ocean waters and migrate to fresh waters). Currently, the FWS shares this authority with the National Marine Fisheries Service.

Stop the High-Speed Money Pit Act This bill prohibits the use of federal funds for a high-speed rail corridor development project in California that is the same or substantially similar to the project that is the subject of a cooperative agreement entered into on December 16, 2009, between the California High-Speed Rail Authority and the Federal Railroad Administration.

Hearing Protection Act This bill removes silencers from the definition of firearms for purposes of the National Firearms Act. It also treats persons acquiring or possessing a firearm silencer as meeting any registration and licensing requirements of such Act. The Department of Justice must destroy certain records relating to the registration, transfer, or making of a silencer. The bill also revises the definitions of firearm silencer and firearm muffler under the federal criminal code and includes such items in the 10% excise tax category.

Concealed Carry Reciprocity Act This bill establishes a federal statutory framework to regulate the carry or possession of concealed firearms across state lines. Specifically, an individual who is eligible to carry a concealed firearm in one state may carry or possess a concealed handgun (other than a machine gun or destructive device) in another state that allows its residents to carry concealed firearms. It sets forth requirements for the lawful concealed carry across state lines. The bill preempts most state and local laws related to concealed carry and establishes a private right of action for a person adversely affected by interference with a concealed-carry right established by this bill.
