Delaware's statewide community college system, operated by Delaware Technical Community College (“the College”), plays a critical role in the State's economy by providing workforce development, vocational training and transfer education that connects Delawareans with good paying jobs within the State and region. This Act gives the College’s Board of Trustees the authority to issue bonds to finance the cost of major and minor capital improvements, deferred maintenance, and the acquisition of related equipment and educational technology and establishes the Community College Infrastructure Fund (“the Fund”) to pay the principal and interest on such bonds. This Act also provides a mechanism, but not an obligation, for the state to provide matching funds for minor capital improvement projects consistent with existing matching provisions for public education. This Act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.
This bill removes the training minimum wage, which takes effect 90 days after enactment, and youth minimum wage, which takes effect January 1, 2020.
This Act creates the Delaware Federal Employees Civil Relief Act which provides the temporary suspension of judicial and administrative proceedings and transactions in Delaware that may adversely affect the civil rights of Federal workers during a shutdown. This Act only applies to Federal workers who reside in Delaware. The Act permits a Federal worker who is furloughed or required to work without pay during a shutdown to apply to a court or administrative agency for a temporary stay, postponement or suspension of any payment of rent, mortgage, tax, fine, penalty, insurance premium, or other civil obligation or liability. A court or administrative agency may grant such relief if it finds that the ability of the Federal worker to pay such obligation has been materially affected by the shutdown. The length of stay may be for the period of the shutdown and 90 days thereafter. This Act also prohibits landlords from evicting a federal worker from premises that are occupied or intended to be occupied primarily as a residence. This Act also prohibits the lapse, termination or forfeiture of the health, life, disability, or motor vehicle insurance policy of a Federal worker without a court order. This Act also places limits on the interest rate that can be imposed on a Federal worker during a shutdown. Finally, this Act empowers the Attorney General to enforce the provisions of the Act and permits a court to impose a civil penalty of not more than $10,000 for violations of the Act.
This Act authorizes the Office of Management and Budget to partner with financial institutions and non-profit providers to establish a temporary loan program for furloughed and unpaid Federal employees as a result of the shutdown caused by a lapse in appropriations.
This is the final leg of an amendment to the Delaware Constitution to provide equal rights on the basis of sex. There is no Equal Rights Amendment to the United States Constitution. While Congress passed the Amendment in 1972, it was not ratified by the requisite number of states by the 1982 deadline. Delaware, however, was one of the first states to ratify the Amendment. About half of the states across the country have passed Equal Rights Amendments to their state constitutions in order to provide protection against discrimination based on sex. Without an Equal Rights amendment, women's rights and protections are limited. This Amendment is necessary to correct a constitutional shortcoming, reduce sex-based disparities and to codify our State's value of equality. Section 1 makes clear the General Assembly's intent in proposing this Amendment to the Delaware Constitution.
This Concurrent Resolution recognizes January 9, 2019, as Law Enforcement Appreciation Day in Delaware.
This Act provides school-based speech-language pathologists and audiologists who hold a current Certificate of Clinical Competence in speech-language pathology, (“CCC-SLP”) or audiology (“CCC-A”), issued by the American Speech-Language and Hearing Association and who hold a current state license to practice from the Delaware Board of Speech Pathologists, Audiologists and Hearing Aid Dispensers with a base salary level of Master’s Plus 30 credits. Professionals who have a CCC-SLP or CCC-A ASHA certification have met the following rigorous academic and professional standards: 1. Successful completion of requisite academic courses by an accredited program. 2. Successful completion of supervised clinical practicum experiences in the practice of speech-language pathology or audiology. 3. Successful completion/passing score on the National Praxis Exam in speech-language pathology or audiology. 4. Successful completion of a Clinical Fellowship. This Act allows speech language pathologists and audiologists who have completed the course work required by state guidelines to apply for an additional 15 credits to move to the Master’s Plus 45 level. This Act contains a grandfather clause that allows school-based speech-language pathologists and audiologists in Delaware who have a master’s degree, a current license, and have worked as a speech-language pathologist for 20 or more years but do not have Certificate of Clinical Competence to, be granted the equivalent pay grade of Master’s Plus 30 with the same additional coursework criteria for moving to Master’s Plus 45 level.
House Substitute No. 1 for House Bill 440 differs from House Bill 440 only in that it locates the Overdose System of Care and the Overdose System of Care Committee in Chapter 97 of Title 16 instead of in Chapter 10 of Title 16. House Substitute No. 1 for House Bill 440 establishes an overdose system of care to improve care, treatment, and survival of the overdose patient in State of Delaware. This Act allows the Secretary of the Department of Health and Social Services to establish stabilization centers that can receive overdose patients from Emergency Medical Services and designate acute health care facilities, freestanding emergency departments, and hospitals that meet established requirements as an overdose system of care centers. This Act also establishes a standing Overdose System of Care Committee to assist in the oversight of the overdose system of care and provide recommendations for its implementation and maintenance.
This Act establishes the Delaware School Safety and Security Fund to allow certain eligible public schools to partially or fully fund projects intended to improve school facilities and training relating to safety or security. The Department of Education shall administer the fund. This Act is effective upon appropriation.
