Under current law, sexual assault can be committed by means of sexual intrusion or penetration when the actor causes submission of the victim by means sufficient to cause submission against the victim's will. The act changes that element to when the actor causes sexual intrusion or sexual penetration knowing the victim does not consent. (Note: This summary applies to this bill as enacted.)

Beginning January 1, 2023, the act increases the salary of full-time newly elected or reelected category II county coroners to match the salary of category II county treasurers, assessors, clerks, and commissioners. The act allows the board of county commissioners to decline the full-time status of a category II county coroner for cause, but only after the coroner is given notice and an opportunity to be heard by the board of county commissioners in a public hearing. The act allows category III and category IV county coroners to work full-time if full-time work is agreed upon in consultation with and approved by the county commissioners. For a category III or category IV county that has a full-time county coroner only, the act increases the salary of a newly elected or reelected county coroner to match the salary of the county treasurer, assessor, clerk, and commissioner. The bill specifies that: A physician, physician assistant, or advanced practice registered nurse with prescriptive authority may prescribe and dispense, and a pharmacist may dispense, therapeutic drugs for off-label use, including hydroxychloroquine sulfate and ivermectin, to provide prophylaxis or outpatient (at-home) and inpatient (hospital) treatment to an individual with COVID-19; and This practice is not unprofessional conduct or otherwise grounds for discipline.(Note: This summary applies to this bill as introduced.)

With the exception of an authorized emergency vehicle or an authorized service vehicle, or in the case of an emergency, the act prohibits drivers of motor vehicles from driving on the Interstate 70 peak period shoulder lanes (PPSL) while the lanes are closed and prohibits drivers of motor vehicles with more than 2 axles or that are 25 feet long or longer from driving on the PPSL at any time. The high-performance transportation enterprise is authorized to assess civil penalties and enforce violations. (Note: This summary applies to this bill as enacted.)

The bill requires the state court administrator to provide the secretary of state with a report of all persons who report as ineligible to serve as a trial or grand juror because they are either not a citizen or do not reside in the county in which they are summoned for juror service. The bill also requires the secretary of state to forward this report to each county clerk and recorder. The bill then requires county clerk and recorders to cancel the voter registration of any elector who is either not a citizen or does not reside in the county and who the county clerk and recorders have received notice of from the state court administrator's report. The secretary of state may cancel the voter registration of any elector who is not a citizen and who the secretary of state has received notice of from the state court administrator's report. Nothing in the bill allows a county clerk and recorder or the secretary of state to cancel the registration of a uniformed-service voter who is absent from the county in which he or she is registered to vote by reason of active duty. The "State Measurement For Accountable, Responsive, and Transparent (SMART) Government Act" (SMART Act) establishes a performance management system to better allow the public, the general assembly, the governor, and state departments to assess, manage, and improve the administration and performance of state programs. The bill adds the office of saving people money on health care, created within the governor's office by executive order, to the list of departments that are required to comply with the requirements of the SMART Act.(Note: This summary applies to this bill as introduced.)
