High-speed rail.

Existing law, the California High-Speed Rail Act, creates the High-Speed Rail Authority to develop and implement a high-speed rail system in the state, with specified powers and duties. Existing law, pursuant to the Safe, Reliable High-Speed Passenger Train Bond Act for the 21st Century, approved by the voters as Proposition 1A at the November 4, 2008, general election, provides for the issuance of $9.95 billion in general obligation bonds for high-speed rail and related purposes. This bill would require the authority to annually adopt a 6-year high-speed train program, as specified, for submission to the chairs of the appropriate policy and budget committees of the Legislature. The bill would also require the authority to annually prepare and submit to the chairs of those committees of the Legislature a report including, among other things, a description of the progress made on the program and a detailed financial plan to pay for construction of the high-speed train network.

Care facilities: change in health status: violations: notice.

Existing law provides for the licensure and regulation by the State Department of Public Health of health facilities, including skilled nursing facilities, intermediate care facilities, and congregate living health facilities. Existing law also provides for the licensure and regulation of residential care facilities for the elderly by the State Department of Social Services. Existing law requires a skilled nursing facility, intermediate care facility, congregate living health facility, or residential care facility for the elderly to make reasonable efforts to contact the person named in the resident's admission agreement as the resident's contact person, or the resident's responsible person, within 24 hours after a significant change in the resident's health or mental status. This bill would make a technical, nonsubstantive change to this requirement.

Relative to Public Service Recognition Week.

This measure would designate the week of May 2 to May 8, 2010, as Public Service Recognition Week, and encourage all Californians to recognize the crucial role of public employees in this state.

Director of California Biotechnology Retention and Recruitment: duties.

Existing law authorizes the Governor to appoint and fix the salaries of assistants and other personnel as the Governor deems necessary for his or her office. This bill would require the Governor to create, within the Office of the Governor, the position of Director of California Biotechnology Retention and Recruitment, as specified. The bill would make the director responsible for serving as an informational resource for biotechnology, life science, and medical companies, as specified.

Relative to Martin Luther King, Jr. Day.

This measure would designate that January 18, 2010, be observed as the official memorial of the late Rev. Dr. Martin Luther King, Jr.'s birth, commemorate Martin Luther King, Jr. Day, the work of Dr. Martin Luther King, Jr., and the Civil Rights Movement in changing public policy in California and in the United States of America.

High school athletics: training for coaches.

(1) Existing law states the intent of the Legislature to establish a California High School Coaching Education and Training Program to be administered by local school districts and to emphasize, among other things, training and certification in cardiopulmonary resuscitation and first aid. Existing law requires each high school sports coach to complete a coaching education program developed by his or her school district or the California Interscholastic Federation that meets specified guidelines. Existing law makes a high school sports coach responsible for the costs of taking the prescribed course. This bill, commencing December 31, 2011, would require all coaches taking or renewing first aid certification to take training that includes a basic understanding of the signs, symptoms, and appropriate emergency action steps regarding potentially catastrophic injuries, including, but not limited to, head and neck injuries, concussions, 2nd impact syndrome, asthma attacks, heatstroke, and cardiac arrest. By requiring high school coaches to complete this additional training, this bill would impose a state-mandated local program. (2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

Air Quality Improvement Program: rebates.

Existing law establishes the Air Quality Improvement Program, administered by the State Air Resources Board (state board) , to fund, upon appropriation by the Legislature, air quality improvement projects related to fuel and vehicle technologies. This bill, in implementing the Clean Vehicle Rebate Project, administered by the California Center for Sustainable Energy, with funds made available by the state board pursuant to the Air Quality Improvement Program would require, rebates to be made available from existing program funds for the purchase of eligible medium- or heavy-duty commercial vehicles from a California manufacturer in an amount 40% greater than the rebates made available for the purchase of eligible medium- or heavy-duty commercial vehicles not from a California manufacturer.

Relative to the Williamson Act.

This measure would recognize the 45th Anniversary of the California Land Conservation Act of 1965, otherwise known as the Williamson Act, and would recognize the value to the state of agricultural land conservation contracts.

Agriculture: fruits, nuts, and vegetables: California Grown Act.

Existing law provides that the terms "California grown," "California-grown," and similar terms with identical connotations shall be used in the labeling or advertising of agricultural products, and authorizes the use of those terms for marketing, advertising, or promotional purposes, only to identify food or agricultural products that have been produced in the state or harvested in its surface or coastal waters. This bill would state legislative findings regarding the marketing of California-grown agricultural commodities within this state. The bill would also state that all state-owned and state-run institutions are encouraged to purchase fruits, nuts, and vegetables that are produced, or produced and processed, in California before those that are produced outside of the state, as long as the price quoted for the California-produced products does not exceed the lowest bid or price quoted for an out-of-state product.
