Governor: powers and duties.

Existing law provides that the Governor is the sole official organ of communication between the government of this state and the government of any other state or of the United States. This bill would make nonsubstantive changes to this provision.

Sierra Nevada Conservancy.

Existing law establishes the Sierra Nevada Conservancy and prescribes the functions and duties of the conservancy with regard to the preservation of specified lands in the Sierra Nevada Region, as defined. Existing law makes specified findings and declarations relating to the importance and significance of the Sierra Nevada Region and the need to protect, conserve, restore, and enhance lands within the region. This bill would make nonsubstantive changes in those findings and declarations.

Department of Business Oversight.

Existing law, the Financial Institutions Law, regulates the activities of various financial entities, including commercial banks, industrial banks, trust companies, credit unions, and savings associations. Existing law establishes the Department of Business Oversight, which is under the direction of the Commissioner of Business Oversight, and is responsible for the administration and enforcement of the Financial Institutions Law. This bill would make nonsubstantive changes to that provision.

Initiative measures: circulating title and summary.

Existing law requires the Attorney General to prepare a circulating title and summary of the chief purposes and points of a proposed initiative measure. This bill would make technical, nonsubstantive changes to that provision.

Controlled substances: fentanyl.

Existing law classifies controlled substances into 5 schedules and places the greatest restrictions and penalties on the use of those substances placed in Schedule I. Existing law classifies the drug fentanyl in Schedule II. Existing law prohibits a person from possessing for sale or purchasing for purposes of sale, specified controlled substances, including fentanyl, and provides for imprisonment in a county jail for 2, 3, or 4 years for a violation of this provision. Existing law also imposes an additional term, and authorizes a trial court to impose a specified fine, upon a person who is convicted of a violation of, or of a conspiracy to violate, specified provisions of law with respect to a substance containing heroin, cocaine base, and cocaine, if the substance exceeds a specified weight. This bill would impose that additional term upon, and authorize a fine against, a defendant who violates those laws with respect to a substance containing fentanyl. By imposing additional incarceration costs on local agencies, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Elections: vote by mail ballots.

Existing law requires that the vote by mail ballot be available to any registered voter and requires an application for a vote by mail voter's ballot to be made in writing to the elections official having jurisdiction over the election between the 29th and the 7th day before the election. Existing law requires any applications received by the elections official before the 29th day to be kept and processed during the application period. This bill would make technical, nonsubstantive changes to this provision.

Arson.

Under existing law, a person is guilty of arson if that person willfully and maliciously sets fire to, burns, or causes to be burned, or aids, counsels, or procures the burning of, a structure, forest land, or property. Existing law makes arson a felony and sets various terms of punishment in the state prison depending on the different types of structures, land, or property to which the arson applies. This bill would make technical, nonsubstantive changes to that provision.

Licenses: seizure and sale.

Existing law authorizes the State Board of Equalization and the Franchise Tax Board to seize and sell the license of an off-sale or on-sale general licensee that, upon termination of business, is delinquent in the payment of taxes due under the Sales and Use Tax Law, Personal Income Tax Law, or Corporation Tax Law, respectively. This bill would additionally authorize the California Department of Tax and Fee Administration to seize and sell those specified licenses under the above-described conditions.

Recreational vehicle donation: registration fee and tax exemptions: state of emergency.

Existing law authorizes the Governor to proclaim a state of emergency under conditions of disaster or of extreme peril to the safety of persons and property within the state, as specified. Existing law generally requires motor vehicles, including certain recreational vehicles, to be registered, and the appropriate fees paid, in order to operate the vehicle on a highway. The Sales and Use Tax Law imposes a tax on the gross receipts from the sale in this state of, or the storage, use, or other consumption in this state of, tangible personal property. This bill would declare the intent of the Legislature to enact legislation to waive otherwise applicable sales and use taxes and vehicle registration fees, upon the donation and transfer of ownership of a recreational vehicle, as defined, if the Governor has proclaimed a state of emergency, and the donee of the recreational vehicle is a person who has suffered a total loss of his or her residence as a result of the event that precipitated the state of emergency.

Mail ballot elections.

Existing law provides for the conduct of mail ballot elections. Under existing law, the ballot at the first general district election conducted solely by mailed ballot must contain a question as to whether all future general district elections shall be so conducted. Existing law applies this requirement only to districts in which an all-mailed ballot election was conducted pursuant to a specified resolution. This bill would make technical, nonsubstantive changes to that provision.
