Employment: working hours.

Existing law, with certain exceptions, establishes 8 hours as a day's work and a 40-hour workweek, and requires payment of prescribed overtime compensation for additional hours worked. Existing law authorizes the adoption by 23 of employees in a work unit of alternative workweek schedules providing for workdays no longer than 10 hours within a 40-hour workweek. This bill would permit an individual nonexempt employee to request an employee-selected flexible work schedule providing for workdays up to 10 hours per day within a 40-hour workweek, and would allow an employer to implement this schedule without any obligation to pay overtime compensation. The bill would require the Division of Labor Standards Enforcement in the Department of Industrial Relations to enforce this provision and adopt regulations. The California Constitution authorizes the Governor to declare a fiscal emergency and to call the Legislature into special session for that purpose. The Governor issued a proclamation declaring a fiscal emergency, and calling a special session for this purpose, on January 8, 2010. This bill would state that it addresses the fiscal emergency declared by the Governor by proclamation issued on January 8, 2010, pursuant to the California Constitution.

Forensic data: DNA.

Existing law, the DNA and Forensic Identification Database and Data Bank Act, as amended by Proposition 69 of the November 2, 2004, statewide general election, which permits legislative amendment for specified purposes, including expeditious crime solving and exoneration, provides that the Department of Justice, through its DNA Laboratory, is responsible for the management and administration of the state's DNA and Forensic Identification Database and Data Bank Program. The act imposes certain requirements on local law enforcement agencies that collect specimens or samples pursuant to these provisions, including that the specimens or samples collected be forwarded immediately to the department and in compliance with department policies. This bill would require that all DNA samples or specimens collected in criminal investigations be processed and analyzed for identification purposes within 30 days of collection.

Health care coverage: FDA approved treatments.

Existing law, the Knox-Keene Health Care Service Plan Act of 1975, provides for the licensure and regulation of health care service plans by the Department of Managed Health Care and makes a willful violation of the act a crime. Existing law also provides for the regulation of health insurers by the Department of Insurance. Existing law requires health care service plan contracts and health insurance policies to provide coverage for certain conditions. This bill would require a health care service plan contract or a health insurance policy that provides coverage of a health condition to also provide coverage for any federal Food and Drug Administration approved treatment of that condition, as specified. Because a willful violation of this requirement by a health care service plan would be a crime, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Student financial aid: State Nursing Assumption Program of Loans for Education: school nurses.

Existing law establishes within the State Nursing Assumption Program of Loans for Education (SNAPLE) , a program under which any person who is enrolled in an eligible institution, and who agrees to work full time as a registered nurse in a state-operated 24-hour facility, including a prison, psychiatric hospital, or veterans home, that employs registered nurses, is eligible to receive a conditional loan assumption agreement, to be redeemed upon becoming employed as a clinical registered nurse in an eligible facility. This bill would establish a program within the SNAPLE, under which a student who is enrolled in an eligible program, and who agrees to be employed as a school nurse in an eligible school or school district, would be eligible to receive a conditional loan assumption agreement, to be redeemed upon becoming employed as a school nurse in an eligible public elementary or secondary school. The bill would provide for a progressive assumption of the amount of a qualifying loan over 4 consecutive years of qualifying employment as a school nurse, up to a total loan assumption of $11,000. The program would be repealed on January 1, 2016.

Science and mathematics instruction.

Existing law establishes the system of public education in this state. Under this system, school districts throughout the state maintain and operate public elementary and secondary schools, which offer instruction to pupils in kindergarten and in grades 1 to 12, inclusive. This bill would express the intent of the Legislature to enact legislation relating to science and mathematics instruction in public elementary and secondary schools.

Unemployment Insurance Appeals Board.

Existing law establishes the Unemployment Insurance Appeals Board in the Employment Development Department, and prescribes the membership, functions, and duties of the board. This bill would make technical, nonsubstantive changes in those provisions governing the membership, functions, and duties of the board.

State Auditor: duties.

Under existing law, the Bureau of State Audits has statutory audit and evaluation duties. This bill would require the State Auditor, on or before January 1, 2010, and every 2 years thereafter, to conduct a performance evaluation of every state government program and expenditure, and submit a report of the results of that evaluation to the Legislature. This bill would also require the State Auditor to make the report easily available to the public, and the Legislature to appropriate funds to the State Auditor sufficient to fulfill these duties.

Pupil assessment: high school exit examination: American history.

Existing law requires the Superintendent of Public Instruction, with the approval of the State Board of Education, to develop a high school exit examination in English language arts and mathematics in accordance with state academic content standards. Existing law requires, commencing with the 2003–04 school year and each school year thereafter, each pupil completing grade 12 to successfully pass the exit examination as a condition of graduation from high school. Existing law requires that each pupil take the high school exit examination in grade 10 beginning in the 2001–02 school year, and allows each pupil to take the examination during each subsequent administration, until each section of the examination has been passed. This bill would require that a reading selection that is used as part of the administration of the examination relate to American history.

Income tax credit: qualified principal residence.

The Personal Income Tax Law authorizes various credits against the taxes imposed by that law. Existing law authorizes a credit against those taxes in an amount equal to the lesser of 5% of the purchase price of a qualified principal residence, as defined, purchased on and after March 1, 2009, and before March 1, 2010, or $10,000, allocated by the Franchise Tax Board on a first-come-first-served basis. Existing law requires a taxpayer to provide the Franchise Tax Board with a certification from the seller of the qualified principal residence that the residence has never been previously occupied within one week of the sale of the residence and caps the total amount of the credit at $100,000,000. This bill would allow the tax credit for purchases of a qualified principal residence made before the date that is 12 months after the effective date of this bill, subject to specified restrictions. This bill would revise the certification requirements to provide that the taxpayer receive the certification no later than one week after the close of escrow on the qualified principal residence and that the Franchise Tax Board be provided with the certification upon request by the board. This bill would also remove the cap on the total credit amount allowed and the requirement that the tax credits be allocated on a first-come-first-served basis. This bill would take effect immediately as a tax levy.

Education: civics.

Existing law provides that no pupil shall receive a diploma of graduation from high school who, while in grades 9 to 12, inclusive, has not completed a one-semester course in American government and civics. This bill would state the intent of the Legislature to enact legislation relating to civics education in public schools.
