Pupil work permits.

Existing law authorizes the superintendent of a school district in which a minor resides, the chief executive officer of a charter school, or specified school employees authorized by the superintendent or chief executive officer in writing, to issue a work permit to a pupil upon receipt of a written request from a parent, guardian, foster parent, or other specified person. A superintendent of a school district also is authorized to designate the principal or another person having charge of a private school to issue work permits. Existing law imposes limits on the number of hours per schoolday and per week that a pupil with a work permit may work. This bill, in addition, would authorize the principal of a public or private school, subject to specified requirements and conditions, to issue, or designate another administrator in the school to issue, work permits to pupils who attend the school. The bill would require that the hour limitations that apply to a work permit issued by any of the officials or employees authorized to issue work permits be based on the school calendar of the school the pupil attends.

Alcoholic beverages.

The Alcoholic Beverage Control Act prohibits any licensee from giving a premium, gift, or free goods in connection with the sale and distribution of any alcoholic beverage, except as provided. This bill would provide that, with regard to beer, a beer manufacturer, as defined, may give consumer advertising specialties to the general public that do not exceed $3 per unit original cost to the beer manufacturer who purchased it. This bill would prohibit a beer manufacturer from requiring a beer wholesaler to fund the purchase of these consumer advertising specialties. This bill would declare that it is to take effect immediately as an urgency statute.

Instructional materials: sale of surplus or undistributed obsolete instructional materials.

Existing law authorizes the State Board of Education and school districts to dispose of surplus or undistributed obsolete instructional materials that are usable for educational purposes, to specified entities, including by sale to any organization that agrees to use the materials solely for educational purposes and to make no charge of any kind to the persons to whom the organization gives or lends the materials. This bill would also authorize county offices of education to dispose of surplus or undistributed obsolete instructional materials under these provisions. The bill would delete the provision requiring the organization to agree to use the materials for educational purposes. The bill would require that all of the proceeds of any sale of surplus or undistributed obsolete instructional materials made under these provisions be available for school districts and county offices of education to acquire basic instructional materials, supplemental instructional materials, or technology-based materials. The bill would also delete a provision requiring the organization to certify that it agrees to use the materials for educational purposes and make no charge to the persons to whom the organization gives or lends the materials.

Vehicles: duplicate or substitute certificate of title or license plate.

(1) Existing law prohibits the Department of Motor Vehicles from issuing a duplicate or substitute certificate of title or license plate if, after a search of the records of the department, the registered owner's address, as submitted on the application, is different from that which appears in the records of the department, unless the registered owner applies in person and presents additional specified documentation, that includes, among other things, a facsimile of specified documents if the facsimile matches the vehicle record of the department. This bill would authorize the use of a photocopy of those documents in lieu of a facsimile. (2) Under existing law, the prohibition described above does not apply under certain circumstances, including when an application for a duplicate or substitute certificate of title or license plate is submitted by a dealer. This bill would make that prohibition also inapplicable to an application for a duplicate or substitute certificate of title or license plate that is submitted by an agent of the dealer. (3) Under existing law, the prohibition described above does not apply under circumstances when the vehicle is registered under the International Registration Plan or under Permanent Fleet Registration, or the vehicle is an implement of husbandry. This bill would make the inapplicability of the above circumstances subject to the discretion of the department. It would also make the prohibition described above inapplicable, at the discretion of the department, when an application for a duplicate or substitute certificate of title or license plate is submitted by a licensed registration service representing specified persons or entities.

Enforcement of judgments: exemptions: homesteads.

Existing law provides that a specified portion of equity in a homestead, as defined, is exempt from execution to satisfy a judgment debt. Existing law provides a base exemption of $50,000, an exemption of $75,000 if the judgment debtor or his or her spouse who resides in the homestead is, at the time of the sale, a member of a family unit, and one member of the family unit is without an interest, or with only a limited interest, as specified, in the homestead, and an exemption of $150,000 if the judgment debtor or the spouse of the judgment debtor who resides in the homestead is, at the time of the sale, 65 years of age or older, disabled, or 55 years of age or older with a limited income, as specified. Existing law requires the Judicial Council to adjust specified exemptions from execution at 3-year intervals based on the change in the annual California Consumer Price Index for All Urban Consumers, and to publish a list of the current dollar amounts of those exemptions, as specified. This bill would increase the homestead exemptions described above to $75,000, $100,000, and $175,000, respectively. The bill would require the Judicial Council to determine, on or before April 1, 2010, and at each 3-year interval ending on April 1 thereafter, to submit to the Legislature the amount by which the dollar amounts of the exemptions applicable to that exempt property may be increased based on the change in the annual California Consumer Price Index for All Urban Consumers. The bill would provide that those increases shall not take effect unless they are approved by the Legislature. The bill would require the Judicial Council to publish a list of the current dollar amounts of those exemptions.

This measure would recognize the pioneering work of promotores and community health workers in delivering vital and cost-effective health care services in communities throughout California and declare October 2009 as California Promotores Month.

Relative to the California Global Warming Solutions Act of 2006.

This measure would urge the State Air Resources Board to meet the statutory requirements of the California Global Warming Solutions Act of 2006 by ensuring that its analysis of specified emission reduction measures include prescribed components.
