California Global Warming Solutions Act of 2006.

The California Global Warming Solutions Act of 2006 (the act) requires the State Air Resources Board (state board) to adopt regulations to require the reporting and verification of emissions of greenhouse gases and to monitor and enforce compliance with the reporting and verification program, and requires the state board to adopt a statewide greenhouse gas emissions limit equivalent to the statewide greenhouse gas emissions levels in 1990 to be achieved by 2020. The act requires the state board to prepare and approve a scoping plan for achieving the maximum technologically feasible and cost-effective reductions in greenhouse gas emissions. The state board is required by January 1, 2011, to adopt greenhouse gas emissions limits and emission reduction measures by regulation to achieve the prescribed emission reductions. This bill would suspend the act until the state unemployment rate is 5.5% or lower for four consecutive calendar quarters. The bill would require the resuspension of the act whenever the state unemployment rate rises above 5.5% for four consecutive calendar quarters. The bill would prohibit the state board, and specified other state agencies, from proposing, promulgating, or adopting any regulation pursuant to the act during a period of suspension and would require that any such regulation adopted prior to January 1, 2011, be inoperative until the suspension is lifted. The bill would request local agencies to refrain from adopting rules, regulations, and policies that derive authority or responsibility from the act and to revise or repeal those rules, regulations, or policies adopted prior to January 1, 2011, until the suspension is lifted.

Fisheries restoration.

The Keene-Nielsen Fisheries Restoration Act of 1985 funded Department of Fish and Game expenditures in fiscal years 1991–92 to 1993–94, inclusive, for the construction, operation, and administration of various projects designated in the plan developed by the department in accordance with the Salmon, Steelhead Trout, and Anadromous Fisheries Program Act, and projects designed to restore and maintain fishery resources and their habitat damaged by past water diversions and projects and other development activities. This bill would make technical, nonsubstantive changes in that funding provision.

Income taxes: exclusion: military retirement benefits.

The Personal Income Tax Law provides various exclusions from gross income in computing tax liability. This bill would provide an exclusion from gross income for retired pay and survivor annuities received by an individual as a result of the active service of a member of the Armed Forces of the United States. This bill would take effect immediately as a tax levy.

Existing law requires the state to pay a death benefit of $10,000 to the surviving spouse or designated beneficiary of any member of the California National Guard, the State Military Reserve, or the Naval Militia who dies or is killed after March 1, 20003, in the performance of duty, as determined by the Military Department. This bill would make technical, nonsubstantive changes to this death benefit provision.

State government: agencies, commissions, boards: repeal.

Existing law authorizes the creation of various state agencies, boards, and commissions. This bill would require that all statutorily created state agencies, boards, and state commissions that are funded by General Fund revenues, except for the Franchise Tax Board, be repealed on January 1, 2022.

Civil actions: enforcement of judgments.

Existing law allows for the enforcement of money judgments, judgments for the possession or sale of personal property or real property, and judgments requiring performance of an act, as provided. This bill would state the intent of the Legislature to amend the provisions relating to the enforcement of judgments.

Instructional materials: surplus or undistributed obsolete.

(1) Existing law provides for the disposition of surplus or undistributed obsolete instructional materials that are usable for instructional purposes in various ways, including, but not limited to, by donation to a nonprofit charitable organization, or by sale to an organization that agrees to use the materials solely for educational purposes. This bill would permit that sale without an assurance that the materials will be used solely for educational purposes. (2) Existing law requires an organization, agency, or institution that receives instructional materials under these provisions to certify that it agrees to use the instructional materials for educational purposes and agrees to make no charge of any kind to the persons to whom the organization gives or lends the instructional materials. This bill would repeal that requirement.

Courts: continuous hours of operation.

Existing law requires all offices of every state agency to be kept open for the transaction of business from 8 a.m. until 5 p.m. of each day from Monday to Friday, inclusive, other than legal holidays, but provides that any state agency or division, or branch or office thereof, may be kept open for the transaction of business on other hours and on other days. This bill would authorize the Chief Justice of the Supreme Court, the presiding justice of a court of appeal, or the presiding judge of a superior court to order the court to operate on a continuous and ongoing basis, 24 hours per day, 7 days per week.

Onsite sewage treatment systems.

Existing law, the Porter-Cologne Water Quality Control Act, on or before January 1, 2004, requires the State Water Resources Control Board, in consultation with others, to adopt regulations or standards for the permitting and operation of specified onsite sewage treatment systems. The act requires the board to apply those regulations or standards to those systems commencing 6 months after their adoption. This bill would repeal those provisions.

Income and corporate taxes: credits: enterprise zones.

The Enterprise Zone Act provides for the designation by the Department of Housing and Community Development of enterprise zones, pursuant to which certain entities may receive regulatory, tax, and other incentives for private investment and employment. The Personal Income Tax Law and the Corporation Tax Law allow a taxpayer to claim certain tax incentives, including credits, for activities conducted in an enterprise zone. This bill would state the intent of the Legislature to enact legislation to revise the enterprise zone credit system to allow a taxpayer authorized to claim those credits to apply the aggregate value of all enterprise zone-related income tax credits toward the taxpayer's tax liability.
