Crime: picketing.

Existing law makes it a crime for a person to disturb, obstruct, detain, or interfere with any person carrying or accompanying human remains to a cemetery or funeral establishment, or engaged in a funeral service or an interment. This bill would make it a crime, punishable by a fine not exceeding $1,000, imprisonment in a county jail not exceeding 6 months, or by both, for a person to engage in picketing, as defined, except upon private property, which is targeted at a funeral, as defined, during the time period beginning one hour prior to the funeral and ending one hour after the conclusion of the funeral. The bill would set forth related findings and declarations. Because this bill would create a new crime, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Registered warrants.

Existing law authorizes a taxpayer who is a payee named in a registered warrant, under certain circumstances, to delay the payment of specified tax liability until the registered warrant is payable by the state. This bill would prohibit a state entity from assessing a fine, interest, or penalty, based on a debt owed to the state by an individual who or entity that is a payee named in a registered warrant, from the date the state issued the registered warrant until at least 30 days after the date the registered warrant is payable by the state.

Income taxation: net operating losses: fraudulent investment arrangement losses.

The Personal Income Tax Law and the Corporation Tax Law, in modified conformity with federal income tax laws, allows a deduction for losses sustained during the taxable year and not compensated for by insurance or otherwise. Those state laws conform to specified revenue rulings and revenue procedures of the Internal Revenue Service regarding treatment of losses due to investment arrangements discovered to be criminally fraudulent, except that, among other things, net operating loss carrybacks and carryforwards are not allowed. This bill would provide a safe harbor for determining the year in which those losses attributable to criminal fraud occurred, as described in a specified revenue procedure of the Internal Revenue Service, and would allow a net operating loss carryover or carryback of any resulting deduction from the losses in conformity with federal income tax law. This bill would make a legislative finding and declaration relating to the public purpose served by the bill. This bill would take effect immediately as a tax levy.

California Public Records Act.

The California Public Records Act requires state and local agencies to make public records available for inspection by the public, subject to specified criteria, and with specified exceptions. This bill would make technical, nonsubstantive changes to these provisions.

Transportation.

Existing law creates various transportation programs to develop and implement improvements to transportation systems. This bill would state the intent of the Legislature to enact legislation enabling the state to examine efficiency in administering solutions to California's transportation needs.

Firearms: handgun safety certificates: fees charged to veterans.

Existing law generally prohibits a person from purchasing or receiving any handgun without a valid handgun safety certificate. Existing law also generally prohibits a person from selling, delivering, loaning, or transferring any handgun to any person who does not have that certificate. Existing law authorizes a certified instructor to charge a fee of $25 for the certificate, of which $15 is paid to the Department of Justice to cover the costs to the department in carrying out and enforcing the provisions governing handgun safety. Existing law requires that all moneys received by the department be deposited into the Firearms Safety and Enforcement Special Fund, a continuously appropriated fund. This bill would provide that a certified instructor shall charge a fee of not more than $10 to any applicant who has been honorably discharged from the United States Armed Forces, the National Guard, or the Air National Guard. The bill would prohibit the department from charging a fee to a certified instructor for each handgun safety certificate issued by the instructor to an applicant who has been honorably discharged from the United States Armed Forces, the National Guard, or the Air National Guard.

Probation.

Existing law provides for the granting of probation to specified offenders under specified circumstances. This bill would make a technical, nonsubstantive change to these provisions. "Probation" means the suspension of the imposition or execution of a sentence and the order of conditional and revocable release in the community under the supervision of a probation officer.

Property taxation: new construction exclusion: fire protection devices.

The California Constitution generally limits ad valorem taxes on real property to 1% of the full cash value of that property. For purposes of this limitation, "full cash value" is defined as the assessor's valuation of real property as shown on the 1975–76 tax bill under "full cash value" or, thereafter, the appraised value of that real property when purchased, newly constructed, or a change in ownership has occurred. Pursuant to an authorization in the California Constitution, existing law excludes from classification as "newly constructed" the construction or installation of any fire sprinkler system, other fire extinguishing system, fire detection system, or fire-related egress improvement that is constructed or installed in an existing building, as specified. This bill would expand this exclusion to include the construction or installation of any fire sprinkler system, other fire extinguishing system, and fire detection system in a new building, as defined, the construction or installation of which is completed on or after January 1, 2012. This bill would require the county assessor to administer this expansion, as provided, and to reduce the base year value of the new building by the value of the fire sprinkler system, other fire extinguishing system, and fire detection system, as specified. By imposing new duties on county assessors, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions. Section 2229 of the Revenue and Taxation Code requires the Legislature to reimburse local agencies annually for certain property tax revenues lost as a result of any exemption or classification of property for purposes of ad valorem property taxation. This bill would provide that, notwithstanding Section 2229 of the Revenue and Taxation Code, no appropriation is made and the state shall not reimburse local agencies for property tax revenues lost by them pursuant to the bill. This bill would take effect immediately as a tax levy.

Public contracts: Department of General Services: approval.

Existing law, with specified exceptions, provides that all contracts entered into by any state agency for the hiring or purchase of goods and services, including equipment, supplies, textbooks, and repair or maintenance, are void unless approved by the Department of General Services. This bill would make technical, nonsubstantive changes to those provisions.
