Existing law authorizes the Office of State Printing, also known as the Office of State Publishing, to accept paid advertisements in materials printed or published by the state, except for paid political advertising. This bill would specifically authorize the office to allow paid advertisements, except for paid political advertising, in materials printed or published by a state agency or vendor. The bill would also provide that funds derived from the paid advertisements be available to the agency, upon appropriation by the Legislature, to fund agency operations. The bill would prohibit the office from accepting or authorizing any paid advertisements in materials printed or published for the Secretary of State. The bill would require the office to receive written consent, as specified, in order to apply these provisions to an executive branch agency administered by a constitutional officer other than the Governor.

Existing law requires employers to withhold tax and make contribution amounts with respect to unemployment insurance, disability insurance, employee training funding, and personal income tax from the wages paid to their employees. Existing law, with specified exceptions, requires that the determination of the employer-employee relationship be made pursuant to common law principles. Existing law defines "employee" for those purposes to include, among other individuals, any officer of a corporation. This bill would additionally include any member of a limited liability company that is treated as a corporation for federal income tax purposes within that definition of "employee" for those purposes. However, the bill would specify that definition of "employee" does not include any member of a limited liability company that is treated as a partnership for federal income tax purposes. Existing law also defines "wages" for those purposes, and exempts from that definition certain remuneration. This bill would provide that wages include compensation, as defined, paid to a member of a limited liability company filing a federal corporate income tax return. By expanding the base of wages subject to unemployment insurance taxes, this bill would deposit additional moneys into the Unemployment Fund, a continuously appropriated fund, and would make an appropriation.
Existing law establishes the California State University and its various campuses under the administration of the Trustees of the California State University. Existing law requires the California State University to offer undergraduate and graduate instruction through the master's degree in the liberal arts and sciences and professional education, including teacher education. This bill, until July 1, 2018, would authorize the California State University to establish a Doctor of Nursing Practice degree pilot program at 3 campuses chosen by the Board of Trustees to award the Doctor of Nursing Practice degree. The bill would distinguish the Doctor of Nursing Practice degree from the doctor of philosophy degree offered at the University of California. The bill would require the Doctor of Nursing Practice degree pilot program to be designed to enable professionals to earn the degree while working full time, train nurses for advanced practice, and prepare clinical faculty to teach in postsecondary nursing programs. The bill would require the California State University to enroll and maintain no more than 90 full-time equivalent students in the degree pilot program at all 3 campuses combined. The bill would require initial funding to come from existing budgets, without diminishing the quality of undergraduate programs or reducing enrollment therein. The bill would require the California State University, the Legislative Analyst's Office, and the Department of Finance to jointly conduct a statewide evaluation of the degree pilot program and report the results to the Legislature and the Governor on or before January 1, 2017.
Existing income tax laws provide that an individual who made a joint return may elect, within 2 years of the date collection activities are initiated, to be relieved from liability for additional taxes and penalties if, among other things, that individual did not know of, and had no reason to know of, an understatement of tax attributable to erroneous items of the other individual filing the joint return. This bill would, as of January 1, 2009, also provide that an individual who has made a joint return and has been granted relief under specified Internal Revenue Code provisions relating to joint and several liability with respect to a federal joint income tax return, is eligible for relief from liability for additional taxes and penalties, except under specified circumstances.
This measure would proclaim April 12 through April 18, 2010, as California Holocaust Memorial Week and would urge Californians to observe these days of remembrance for the victims of the Holocaust in an appropriate manner.
This measure would urge the President of the United States, the United States Congress, and the Department of Defense to take immediate and necessary actions to protect national security by ensuring continuation of C-17 production to meet future domestic and international airlift needs and to preserve the crown jewel of the American industrial base.
Existing law provides for the licensure and regulation of occupational therapists by the California Board of Occupational Therapy, which consists of 7 members, including 3 public members. Existing law prohibits the public members from being licensees of the board, the State Board of Chiropractic Examiners, or the Osteopathic Medical Board of California. This bill would also prohibit the public members from being licensees of any other healing arts board and would delete certain obsolete language.
This measure would honor the 50th anniversary of the flying of the current American flag and would encourage all Californians to celebrate the occasion with appropriate activities.
Existing law, the Medical Practice Act, provides for the licensure and regulation of physicians and surgeons by the Medical Board of California and for the licensure and regulation of podiatrists by the California Board of Podiatric Medicine within the Medical Board of California. Existing law exempts a licensee of either of those boards from liability for civil damages for acts or omissions by the licensee in rendering specified emergency care and for injury or death caused in an emergency situation occurring in the licensee's office or a hospital on account of a failure to inform a patient of the possible consequences of a medical procedure, as specified. Existing law prohibits construing these provisions to authorize a podiatrist to act beyond certain scope of practice limitations. This bill would delete that prohibition and would state the Legislature's intent regarding that deletion.
Existing law authorizes the board of supervisors of a county, to acquire by eminent domain, and convey lands to the United States for any military purpose authorized by any law of the United States, and authorizes the board to incur an indebtedness evidenced by negotiable bonds of the county for these purposes. This bill would repeal those authorizations.
