Relative to Irish American Heritage Month.

This measure would designate March 2016 as Irish American Heritage Month in honor of the multitude of contributions that Irish Americans have made to the country and state.

Substance abuse: structured sober living homes.

Existing law provides for the licensure and regulation of alcoholism or drug abuse recovery or treatment facilities serving adults by the State Department of Health Care Services, as prescribed. This bill would authorize a city, county, or city and county to enact an ordinance to register structured sober living homes, consistent with specified state and federal law, and with specified exclusions. The bill would define a structured sober living home as any premises, place, or building that provides groups of unrelated adults recovering from drug or alcohol addiction with alcohol‑free and drug‑free housing, promotes independent living and life skill development, and provides structured activities that are directed primarily toward recovery from substance use disorders in a supervised setting. The bill would specify registration and other requirements applicable to structured sober living homes. A structured sober living home, as defined by and registered pursuant to the bill, would not be subject to existing state licensure and regulation requirements for alcoholism or drug abuse recovery or treatment facilities. The bill would provide that it does not establish a new category of state-licensed facility, or otherwise authorize a structured sober living home registered pursuant to an ordinance adopted under the bill to provide any service for which a license is required by state law.

Abortion services facilities: pregnancy center notice.

Existing law requires a licensed covered facility, as defined, to disseminate to clients a notice, as specified, stating that California has public programs that provide immediate free or low-cost access to comprehensive family planning services, prenatal care, and abortion for eligible women. Existing law requires an unlicensed covered facility, as defined, to disseminate to clients a notice, as specified, stating that the facility is not licensed as a medical facility by the State of California and has no licensed medical provider. Existing law authorizes the Attorney General, city attorney, or county counsel to bring an action to impose a specified civil penalty against covered facilities that fail to comply with these requirements. This bill would require a facility that offers abortion services to disseminate a notice to clients, as specified, providing the telephone number for a specified organization and stating that pregnancy centers can provide women with services at no cost that include consultation, pregnancy tests, sexually transmitted disease or sexually transmitted infection (STD/STI) testing, ultrasound services, support groups, parenting programs, and material assistance.

Veterans: Employment Development Department.

Existing law authorizes the Employment Development Department, within the Labor and Workforce Development Agency, to perform various functions and duties with respect to job creation and retention activities. Existing law requires the department to research the needs of veterans throughout the state and develop a profile of veterans' employment and training needs. Existing law requires the department to develop a statewide plan for the equitable distribution of employment funds for veterans' employment services. Existing law authorizes the board of supervisors of each county to appoint a county veterans service officer to provide veteran-related services. This bill would require the Employment Development Department, upon request of the local county veterans service officer, to provide training to the county veterans service officer and his or her staff in providing assistance to veterans applying for unemployment insurance benefits. The bill would require the Employment Development Department to coordinate with county veterans service officers for purposes of becoming familiar with the services provided by county veterans service officers. The bill would further require the Employment Development Department to establish a system to refer veterans to county veterans service officers for purposes of determining eligibility for benefits.

Cognitively impaired adults: caregiver resource centers.

Existing law requires the Director of Health Care Services to, among other things, maintain or enter into contracts directly with nonprofit caregiver resource centers (CRCs) to provide direct services to caregivers of cognitively impaired adults, as defined, throughout the state. These services include, but are not limited to, specialized information, family consultation, respite care, short-term counseling, and support groups. This bill would, each fiscal year, commencing with the 2016–17 fiscal year, appropriate $3,300,000 from the General Fund to the State Department of Health Care Services for allocation to CRCs for the purpose of providing those respite care services. The bill would also authorize those services to be provided in-person and, except for respite care services, through the use of remote technologies.

Service stations: petroleum supply and pricing.

Existing law requires every service station in this state to display at a conspicuous place on, at, or near the dispensing apparatus, or at or near the point of sale, at least one clearly visible sign showing a list of applicable state and federal fuel taxes per gallon of motor vehicle fuel sold from the dispensing apparatus. A violation of this provision is an infraction. Existing law establishes the State Energy Resources Conservation and Development Commission in the Natural Resources Agency, and specifies the powers and duties of the commission with respect to energy resources in the state. Under existing law, various provisions regulate petroleum supply and pricing. The California Global Warming Solutions Act of 2006 designates the State Air Resources Board as the state agency charged with monitoring and regulating sources of emissions of greenhouse gases. The act authorizes the state board to include the use of market-based compliance mechanisms. This bill would require every service station to also display the average per-gallon cost of gasoline and diesel fuel, as annually calculated by the commission in consultation with the Legislative Analyst's Office, across the industry of refiners producing transportation fuels as a result of their compliance with a market-based compliance mechanism. Because a violation of this requirement would be a crime, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Property taxation: exemptions: disabled veterans.

Existing property tax law provides, pursuant to the authorization of the California Constitution, a disabled veterans' property tax exemption for the principal place of residence of a veteran or a veteran's spouse, including an unmarried surviving spouse, if the veteran, because of injury incurred in military service, is blind in both eyes, has lost the use of 2 or more limbs, or is totally disabled, as those terms are defined, or if the veteran has, as a result of a service-connected injury or disease, died while on active duty in military service. Existing law exempts that part of the full value of the residence that does not exceed $100,000, or $150,000, if the veteran's household income does not exceed $40,000, adjusted for inflation, as specified. This bill, for property tax lien dates for the 2017–18 fiscal year and for each fiscal year thereafter, would instead exempt that portion of the full value of the principal place of residence of a veteran or veteran's spouse that does not exceed $1,000,000, adjusted annually for inflation, as specified. The bill would also define the term "blind in both eyes" to mean that the veteran is a blind person, as defined in a specific statute. The bill would also specify that a "totally disabled" veteran includes a veteran so severely disabled as to be unable to move without the aid of an assistive device. The bill would make other technical and conforming changes to the disabled veterans' property tax exemption. By changing the manner in which local tax officials administer the disabled veterans' property tax exemption, this bill would impose a state-mandated local program. Section 2229 of the Revenue and Taxation Code requires the Legislature to reimburse local agencies annually for certain property tax revenues lost as a result of any exemption or classification of property for purposes of ad valorem property taxation. This bill would provide that, notwithstanding Section 2229 of the Revenue and Taxation Code, no appropriation is made and the state shall not reimburse local agencies for property tax revenues lost by them pursuant to the bill. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions. This bill would take effect immediately as a tax levy.

Science, Technology, Engineering, and Mathematics Partnership Academies.

Existing law establishes a system of public elementary and secondary education, with instruction provided by school districts at schoolsites throughout the state. The State Department of Education, under the administration of the Superintendent of Public Instruction, has numerous duties with respect to the funding and conduct of the instructional activities undertaken by school districts. This bill would establish a program for purposes of providing grants to school districts for the establishment of up to 100 partnership academies dedicated to training young people in science, technology, engineering, and mathematics (STEM) occupations.

Postsecondary education: tuition and fees.

Existing law requires the Regents of the University of California, the Board of Directors of the Hastings College of the Law, the Trustees of the California State University, and the governing board of each community college district to collect fees from students attending those postsecondary education institutions. This provision is applicable to the Regents of the University of California only if the regents, by resolution, make it applicable. This bill would prohibit the regents, the trustees, and the governing board of each community college district from collecting any fees or tuition of any kind from a student in an undergraduate program who is the surviving dependent, as defined, of any individual killed in the terrorist attack in San Bernardino on December 2, 2015, if the dependent meets the financial need requirements of the Cal Grant A Program and either the dependent was a resident of California on December 2, 2015, or the individual killed in the attack was a resident of California on that date. The bill would require the governing board of each community college district to waive fee requirements for any student in an undergraduate program who is a surviving dependent. The bill would require the California Victim Compensation and Government Claims Board to identify all persons who are eligible for tuition and fee waivers pursuant to the bill, to notify these persons or their parents or guardians of that eligibility, and, if requested by the public segments of postsecondary education in the state, on a case-by-case basis, to confirm the eligibility of persons requesting the waiver of tuition and fees. The bill would apply to the University of California only if the regents, by resolution, make it applicable. To the extent that the bill would impose new duties on community college districts, it would constitute a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions. This bill would declare that it is to take effect immediately as an urgency statute.
