Relative to undocumented criminals.

This measure would urge Congress and the President to restore full funding for the State Criminal Alien Assistance Program and to fully reimburse states for the cost of incarcerating undocumented criminals.

Personal Income Tax Law: exclusion: military veterans: combat zone compensation and disability retirement payments.

The Personal Income Tax Law provides various exclusions from gross income in determining tax liability, including an exclusion for death benefit payments received by a surviving spouse or other beneficiary designated by a military veteran, as prescribed, who dies or is killed in the performance of duty, as provided. This bill would, for taxable years beginning on or after January 1, 2010, exclude from gross income, as provided, Combat-Related Special Compensation (CRSC) and Concurrent Retirement and Disability Pay (CRDP) payments, as defined, received by an eligible individual, as defined. This bill would make these provisions inoperative on January 1, 2018. This bill would take effect immediately as a tax levy.

School employees: discipline: suspension and dismissal.

(1) Existing law authorizes a governing board of a school district to give notice to a permanent employee of its intention to dismiss or suspend him or her for specified causes at the expiration of 30 days from the date of service of the notice, unless the employee demands a hearing. Existing law prohibits that notice from being given between May 15th and September 15th in any year. This bill would remove that prohibition. (2) Existing law establishes a Commission on Professional Competence for each dismissal or suspension hearing requested by an employee, consisting of specified members. Existing Existing"?> law prohibits testimony from being given or evidence being introduced at the hearing relating to matters that occurred more than 4 years prior to the date of the filing of the notice of dismissal or suspension. This bill would remove that 4-year limitation, and would make nonsubstantive changes.

Public postsecondary education: nonresident tuition: military members.

Existing law establishes the segments of the public postsecondary education system in the state, including the University of California administered by the Regents of the University of California, the California State University administered by the Trustees of the California State University, and the California Community Colleges administered by the Board of Governors of the California Community Colleges. Existing law establishes uniform student residency requirements for purposes of ascertaining the amount of fees to be paid by students at these segments of public postsecondary education. This bill would require a student, or a spouse of a person, who is a former member of the Armed Forces of the United States or the State Military Reserve who served for at least 36 months and received a specified discharge, to be exempt from paying nonresident tuition for his or her first year of continuous enrollment at the California State University and the California Community Colleges if he or she files an affidavit with the institution stating his or her intent to establish residency in California as soon as possible, and would request that such a person be exempt from paying nonresident tuition for his or her first year of continuous enrollment at the University of California. By requiring community college districts to exempt these persons from paying nonresident tuition, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

State responsibility areas: fire prevention fees.

Existing law requires the State Board of Forestry and Fire Protection, on or before September 1, 2011, to adopt emergency regulations to establish a fire prevention fee in an amount not to exceed $150 to be charged on each structure on a parcel that is within a state responsibility area, as defined, and requires that the fire prevention fee be adjusted annually using prescribed methods. Existing law requires the State Board of Equalization to collect the fire prevention fees, as prescribed, commencing with the 2011–12 fiscal year. Existing law establishes the State Responsibility Area Fire Prevention Fund and prohibits the collection of fire prevention fees if, commencing with the 2012–13 fiscal year, there are sufficient amounts of moneys in the fund to finance specified fire prevention activities for a fiscal year. Existing law requires that the fire prevention fees collected, except as provided, be deposited into the fund and be made available, to the board and the Department of Forestry and Fire Protection for certain specified fire protection activities that benefit the owners of structures in state responsibility areas who are required to pay the fee. Existing law further requires the board, on and after January 1, 2013, to submit an annual written report to the Legislature on specified topics. This bill would repeal the above provisions relating to the fire prevention fees.

State employment: military service: inactive duty training.

Existing law requires that a civil service employee who is granted short-term military leave of absence for active military duty receive his or her salary or compensation for the first 30 days of active duty during the absence, if specified conditions are met. This bill would additionally require that a civil service employee who is granted short-term military leave of absence for inactive duty training receive his or her salary or compensation for the first 30 days of inactive duty training during his or her absence, if specified conditions are met.
