Community colleges: tutoring.

Existing law establishes the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in this state. Under existing law, community college districts throughout the state have established campuses where they provide instruction to students. Existing law establishes a system through which state funds are apportioned to community college districts based on specified formulas. A provision of existing law identifies the noncredit community college courses and classes that are eligible for state apportionment funding. This bill would provide that supervised tutoring for courses and classes in all subject areas that are either basic skills, degree applicable, or transfer level, irrespective of whether a student being tutored has been referred to tutoring by a faculty member or has self-initiated the tutoring, is eligible for state apportionment funding. The bill would also make technical and conforming changes in this provision. The bill would require the board of governors to amend, as soon as feasible, a designated provision of the California Code of Regulations to include student-initiated tutoring, in accordance with the bill.

Property tax: exemptions: personal property used in space flight.

The California Constitution authorizes the Legislature to classify personal property for differential taxation or for exemption by means of a statute approved by a 23 vote of the membership of each house. Pursuant to this constitutional authorization, existing property tax law, for the January 1, 2014, lien date to and including the January 1, 2024, lien date, exempts qualified property, as defined, for use in space flight, as specified. Existing law repeals this exemption as of July 1, 2025. This bill would extend to an unspecified date the operation of the property tax exemption for qualified property used in space flight. By extending the operation of this exemption, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above. Existing law requires the state to reimburse local agencies annually for certain property tax revenues lost as a result of any exemption or classification of property for purposes of ad valorem property taxation. This bill would provide that, notwithstanding those provisions, no appropriation is made and the state shall not reimburse local agencies for property tax revenues lost by them pursuant to the bill. This bill would take effect immediately as a tax levy.

Relative to the Armenian Genocide.

This measure would, among other things, designate the year 2018 as "State of California Year of Commemoration of the Anniversary of the Armenian Genocide of 1915–1923," would designate April 24, 2018, as "State of California Day of Commemoration of the 103rd Anniversary of the Armenian Genocide of 1915–1923," and would call upon the President of the United States and the United States Congress to formally and consistently reaffirm the historical truth that the atrocities committed against the Armenian people constituted genocide.

Relative to California Peace Officers' Memorial Day.

This measure would designate Monday, May 7, 2018, as California Peace Officers' Memorial Day, urge all Californians to use that day to honor California peace officers, and recognize specified California peace officers who were killed in defense of their communities.

War on Terror Memorial Committee.

Existing law prescribes various duties for the Department of General Services in connection with the development and maintenance of the park around the State Capitol Building. Existing law authorizes the construction of various memorials in the Capitol Historic Region. This bill would establish the War on Terror Memorial Committee, and would require the committee, in consultation with the department, to conduct a review of the feasibility and best practices for the establishment and construction of a War on Terror Memorial in or around the State Capitol Park. The bill would also require the committee to report its findings and recommendations to the Legislature, as provided, and would prohibit the expenditure of state funds for purposes of implementing its provisions.

Public contracts: sanitation districts: notice.

Existing law authorizes a sanitation district to make and perform any agreement with a public or private corporation of any kind or a person for the joint construction, acquisition, disposition, or operation of any property or works of a kind that might be constructed, acquired, disposed of, or operated by the district. Existing law requires a district, when an expenditure for work exceeds $35,000, to contract with the lowest responsible bidder after notice. Existing law requires the notice to be published, at least twice, not less than 5 days apart, in a newspaper of general circulation, printed and published in the district, or if there is none, to be posted in at least 3 public places in the district that have been designated by the district board as places for posting this notice. This bill would instead require the notice to be published in a manner that the district board determines to be reasonable, which may include, but is not limited to, newspapers, Internet Web sites, radio, television, or other means of mass communication.

A resolution to propose to the people of the State of California an amendment to the Constitution of the State, by amending Sections 1 and 2 of Article XIII C thereof, and by amending Sections 2 and 3 of Article XIII D thereof, relating to local government.

The California Constitution conditions the imposition of a general tax by a local government upon the approval of a majority of its voters voting on the tax. The California Constitution requires the election for the vote on a general tax to be consolidated with a regularly scheduled election for members of the governing body of the local government, except in cases where the members of the governing body of the local government, by a unanimous vote, declare an emergency. The California Constitution conditions the imposition of a special tax by a local government upon the approval of 23 of the voters voting on the tax. The California Constitution defines "local government" for these purposes to mean any county, city, city and county, including a charter city or county, any special district, or any other local or regional governmental entity. This measure would specify that the electorate exercising its initiative power is within the definition of "local government," and that these conditions and requirements apply to the exercise of that power. The California Constitution prohibits an assessment or property-related fee or charge from being assessed by an agency on any parcel of property unless it meets certain requirements. Existing provisions of the California Constitution require an agency to follow specified procedures in imposing or increasing an assessment or property-related fee or charge, and condition the imposition or increase of an assessment or property-related fee or charge, with certain exceptions, upon the absence of a majority protest on the part of owners of affected parcels and, in the case of a property-related fee or charge, upon approval by either a majority vote of the owners of the subject parcels or a 23 vote of the voters residing in the affected area. The California Constitution defines "agency" for these purposes to mean any county, city, city and county, including a charter city or county, any special district, or any other local or regional governmental entity. This measure would specify that the electorate exercising its initiative power is within the definition of "agency," and that the existing requirements and procedures apply to the exercise of that power.

Child abuse reporting: cross-reporting among local agencies.

Existing law requires a county probation or welfare department to immediately, or as soon as practicably possible, report to the law enforcement agency having jurisdiction over the case, to the agency given responsibility for investigation of child welfare cases, and to the district attorney's office every known or suspected instance of child abuse or neglect, as specified. Existing law states the intent of the Legislature that the law enforcement agencies and the county welfare or probation department of each county develop and implement cooperative arrangements in order to coordinate existing duties in connection with the investigation of suspected child abuse or neglect cases. Existing law requires a local law enforcement agency having jurisdiction over a reported case of child abuse to report to the county welfare or probation department that it is investigating the case, and requires the county welfare department or probation department, in certain cases, to evaluate what action or actions would be in the best interest of the child and to submit its findings to the district attorney, as specified. This bill would, no later than January 1, 2029, require each county to establish a private and secure online database for cross-reporting substantiated reports of child abuse and neglect. The bill would require each county to develop a process for a person to petition to have his or her name removed from the database if the report regarding the individual is unsubstantiated. The bill would require each database to be implemented with policies to oversee the sharing of information, including, but not limited to, cross-reporting among the county welfare department, the district attorney's office, and local law enforcement agencies, to ensure that each agency carries out its mandated investigative response to reports of child abuse or neglect. The bill would require unsubstantiated reports to be purged from the database. The bill would state findings and declarations of the Legislature regarding reporting child abuse and neglect. By imposing new duties on counties, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.
