Relative to Trauma-Informed Awareness Day.

This measure would designate May 22, 2018, as Trauma-Informed Awareness Day in California, in conjunction with National Trauma-Informed Awareness Day, to highlight the impact of trauma and the importance of prevention and community resilience through trauma-informed care.

State Capitol Park: California Lesbian, Gay, Bisexual, Transgender (LGBT) Civil Rights Monument.

Existing law prescribes various duties for the Department of General Services in connection with the development and maintenance of the park around the State Capitol Building. Existing law also authorizes the construction of various memorial monuments in the Capitol Historic Region. This bill would authorize the California Legislative LGBT Caucus Foundation, in consultation with the California Legislative LGBT Caucus and the department, to plan and undertake construction of a monument honoring California's LGBT movement's civil rights history within the State Capitol Park. The bill would require the California Legislative LGBT Caucus Foundation and the California Legislative LGBT Caucus, if they undertake responsibility to construct a monument pursuant to these provisions, to establish a schedule for the design, construction, and dedication of the monument. The bill would require the department to meet specified goals. The bill would also require the planning, construction, and maintenance of the monument to be funded exclusively through private donations.

Damages: lead-based paint.

Existing law authorizes a person who suffers a loss or harm to person or property from the unlawful act or omission of another to recover from the person at fault money damages. This bill would allow the injured party, in any action to recover damages for injury to person or property caused by lead-based paint, to establish a prima facie case that a particular lead paint pigment manufacturer is the cause of the injury if the injured party proves by a preponderance of the evidence that the lead paint pigment manufacturer sold, distributed, or promoted in California either the type of lead paint pigment that caused the injury or a product containing the type of lead paint pigment that caused the injury, and would shift the burden of proof to the lead paint pigment manufacturer to prove by a preponderance of the evidence that it did not sell, distribute, or promote the lead paint pigment that caused the injury or a product containing the type of lead paint pigment that caused the injury during the relevant time period or in the geographical market in which the injury occurred. The bill would make each lead paint pigment manufacturer jointly and severally liable if more than one lead paint pigment manufacturer is found liable for an injury to person or property caused by lead-based paint. The bill would expressly make these provisions retroactive. The bill would also state various findings and declarations of the Legislature related to these provisions. The bill would provide that its provisions are severable.

Relative to Child Abuse Prevention Month.

This measure would acknowledge the month of April 2018 as Child Abuse Prevention Month and encourage the people of the State of California to work together to support youth-serving child abuse prevention activities in their communities and schools.
